Inspector Notes

An unannounced monitoring inspection was conducted on-site on 10/12/2022 and concluded with electronic record review on 10/19/2022. There were 14 children, ages 3 years-5 years, and 2 staff members providing direct supervision present during the inspection. The inspector reviewed compliance in the areas of administration, staff qualifications and trainings, physical plant, staffing and supervision, programs, special care provisions and emergencies and special services. The children were observed during teacher directed activities and rest time. The inspector discussed the following with the provider: handwashing and staff records. A total of 5 children?s records, and 2 staff records were reviewed. The inspector arrived for the on-site inspection at 10:45 am and departed at 12:15 pm.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation noticed issued to the provider.

Standard 22.1-289.035-A
Based on the record review and interview with staff, the center failed to ensure that all employees shall undergo a background check in accordance with the Code of Virginia prior to employment or beginning to serve as a volunteer and every five years thereafter.
Evidence: The record for Staff 1 contained the findings from a search of the central registry dated 09/26/2016; the repeat results of the search of central registry was not available for review during the inspection. A request was dated 08/30/202 and Staff 3 confirmed results were not available for review.

Standard 22.1-289.035-B-2
Based on the record review, the center failed to ensure that no person shall be hired for compensated employment prior to the facility obtaining an employment eligibility letter upon the completion of a fingerprint background check as required by the Code of Virginia.
Evidence: The hire date for Staff 2 was 08/09/2021. The employment eligibility letter was dated 08/13/2021.

Based on record review, the center failed to ensure that an employee must not be employed until the agency has the person?s completed sworn statement or affirmation.
Evidence: The hire date for Staff 2 was 08/09/2021. The sworn statement was dated 08/10/2021.

Based on record review, the center failed to obtain the finding from a search of the central registry within 30 days of employment.
