63.2 Child Abuse & Neglect
During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.
Inspector Notes
An unannounced monitoring inspection was initiated on 3/25/2025 and completed on 7/18/2025 in response to a self-report received by the licensing office on 3/3/2025 relating to Behavior Guidance, Forbidden Actions and Operational Responsibilities. The inspector reviewed 1 child record and 1 staff record on-site on 3/25/2025. This inspection included document review, interviews and observations.
Information gathered during the inspection determined non-compliance with applicable standards or law, and violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five business days from today, which will be the close of business on 7/25/2025. A POC submitted after this date will not appear on the public website.
Violations
3The center?s written policies state:
? Redirection will be used by staff to stop an undesirable behavior. Staff will direct the child to a desirable activity? and ?Children ??are given a short time away from the group, in order to calm down and gain self-control?.
Staff #1 repeatedly returned a two-year-old child (child #1) to sit at the picnic table or on the ground, over a period of approximately 9 minutes before leading child #1 off the playground and back into the building. Child #1 was not calmed by being separated from the group of children but continued to cry and repeatedly attempted to move away from the areas where she had been placed. Child #1 was not redirected to another desired behavior or activity.
Staff #1 utilized behavior guidance which was neither constructive in nature, age appropriate, nor intended to redirect the child to an appropriate behavior when she placed and repeatedly returned child #1 (two years old) to sit, on a bench and on the ground in front of a storage shed area, away from the other children on the outdoor play area with no available activities or opportunities to redirect her behavior appropriately. Child #1was returned repeatedly to sit down over a period of approximately 9 minutes. After one attempt by child #1 to leave, staff #1 placed her foot on the bench between the child?s thighs in a manner that prevented child #1 from being able to slide down from the bench to a standing position.
On 3/3/2025 staff #1 lifted and roughly sat a two-year-old child (Child #1) onto the picnic table bench 5 separate times, over an approximate 3-minute time span.
Staff #1 Grasped and lifted child #1 by her forearm swinging her up off of her feet and onto the ground where she landed on her bottom, then, minutes later, grasped child #1?s wrist pulling her back onto the ground a second time where she toppled over onto her back when she landed.
