Inspector Notes

An unannounced complaint inspection was initiated on 5/16/2022 and concluded on 6/6/2022 in response to a complaint that was received by the licensing department on 5/13/2022 regarding allegations of behavior guidance and forbidden action. On 5/16/2022 two inspectors were on site from 10:10 am to 10:55 am. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. Additional documentation and interviews were conducted remotely.

The preponderance of the evidence gathered during the investigation does not support the allegation; therefore, the complaint is determined to be not valid. Though not a part of the original complaint, there was a violation found during the inspection regarding out of state background check requirements. See the violation notice for more details.

Please complete the ?plan of correction? and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today. You will need to specify how the deficient practice will be or has been corrected. Just writing the word ?corrected? is not acceptable. Your plan of correction must contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventative measures. Please do not use staff names; list staff by positions only.

Based on a review of 2 staff records and interview, the center did not ensure to request an out of state child abuse and neglect search for 1 staff by the end of the 30th day of employment as required.

Evidence:
1. The record of staff #1 (DOH: 9/23/2021) contained a sworn statement that indicated that the staff had resided outside of the state within the preceding 5 years. The record did not contain the request for an out of state child abuse and neglect search.
2.Administration acknowledged that the request was missing.
