Inspector Notes
The inspection findings have been updated as a result of a first step review completed on 3/24/2023.
An unannounced monitoring inspection was conducted on 1/19/23 at 11:15am to 3:00pm with another licensing inspector and continued on 1/26/23 at 9:30am to 3:25pm and on 1/30/23 at 1:20pm to 4:30pm with the local agency and another licensing inspector to investigate a self-reported incident at the center regarding a forbidden action. Interviews were conducted with 6 staff members, a parent and the child. Attendance documentation, allergy lists, 4 Staff statements, 5 child files, and 3 staff files were reviewed. Classrooms and the physical plant were observed as well. An exit interview was conducted on 2/24/2023. Violations
6Evidence:
1)On 1/10/2023 at approximately 6:20pm, a parent reported to management after picking up her child from the center, that Child #1 (age 7 years old) stated to the parent that their teacher had picked the child up by their arm and the child had marks on their arm. Management staff looked at the child?s arm and confirmed seeing redness on the child?s arm on 1/10/23.
2)The parent sent photos of the child?s arm to management on 1/10/23 at approximately 6:23pm, on 1/10/23 at approximately 8:47pm, and on 1/12/23 at approximately 7:02am.
3)Based on documentation and interview, the center reported the incident to Child Protective Services (CPS) on 1/12/23.
Evidence:
1)On 1/10/23, at approximately 4:40pm-5:30pm during an incident involving the behavioral guidance of a Child #1, Staff #1 left Child #1 (age 7) alone in a hallway outside of the classroom to ?take a break?.
2)Based on interviews with staff and the child, the door to the classroom was closed at various times during the approximately 50 minutes the child was alone.
Evidence:
Attendance sheets that were used on 1/3/23-1/11/23 showed the Private Kindergarten classroom to be outside of the appropriate ratio for the age group. The center did not maintain the required supervision ratio of 1 staff for every 10 children based on the youngest child (age 4) in the classroom. Staff #1 confirmed that they are regularly out of ratio.
1)On 1/3/2023, at approximately 10:00am-4:00pm, Child #2, Child #3, and Child #4 were in a classroom that had up to 31 children with 2 staff members.
2)On 1/6/2023, at approximately 3:18pm-3:56pm, Child #2, Child #3 and Child #4 were in a classroom that had up to 14 children with 1 staff member. A
3)On 1/6/2023 at approximately 4:00pm-4:50pm, Child #2, Child #3 and Child #4 were in a classroom that had up to 24 children with 2 staff members.
4)On 1/10/2023, at approximately 3:18pm-4:41pm, Child #2, Child #3 and Child #4 were in a classroom that had up to 24 children with 1 staff member.
5)On 1/11/2023, at approximately 4:10-5:00pm, Child #2, Child #3 and Child #4 were in a classroom that had up to 25 children with 2 staff members.
Evidence: On 1/10/23, Child #1 stated that when they became upset in the classroom, Staff #1 roughly handled Child#1 by grabbing their arm, picking them up, and placing them in the hallway to ?take a break?. There were red marks left on the child?s arm that later bruised.
Evidence: Child #1 was separated from their group and alone in the hallway outside the classroom for approximately 50 minutes and was not in the vision and hearing of a staff member.
Evidence: Upon review of written attendance records from 1/3/23-1/13/23, it was determined that departure was not documented for each child in care as it occurs.
1)On 1/3/23, departure was not documented for 6 children in the classroom for ages 4 and up.
2)On 1/4/23, departure was not documented for 2 children in the classroom for ages 4 and up.
3)On 1/5/23, departure was not documented for any of the 28 children in the classroom for ages 4 and up.
4)On 1/6/23, departure was not documented for 6 children in the classroom for ages 4 and up.
5)On 1/9/23, departure was not documented for any of the 18 children in the classroom for ages 4 and up.
6)On 1/12/23, departure was not documented for 23 children in the classroom for ages 4 and up.
7) On 1/13/23, departure was not documented for 18 children in the classroom for ages 4 and up.
