Inspector Notes
An unannounced monitoring inspection was conducted on 12/21/2023 from 12:05pmm to 2:30pm as the result of a self-reported incident regarding behavioral guidance. Documentation was reviewed, classrooms were observed, and interviews were conducted. Based on the evidence collected during the inspection, a violation was written related to the incident. There was one other violation noted during the process of the inspection that can be seen on the violation report. The exit interview was conducted on 1/8/24 with management. Areas of non-compliance unrelated to the complaint are identified in the Violation Notice.

Violations
2Evidence:
The file for Staff #1 (date of hire 8/21/23) did not contain documentation of a negative tuberculosis (TB) test or screening at the time of employment. The TB screening on file was completed on 8/22/23.
Evidence:
1)Interviews from staff witnesses indicated Staff #1 became frustrated with a child in the PS2A classroom (a Two year old classroom) and pushed the child forcefully on the back of the head in order to redirect the child towards the rest of the children in line getting ready to go outside. Staff indicated the child stumbled forward and that the staff member was not gentle with the child. Staff behavior in this situation is not constructive in nature, age and stage appropriate, or intended to redirect a child to appropriate behavior and resolve conflicts.
2)Interviews from staff witnesses indicate that Staff #2 regularly yells at the children in the PS3A classroom when they become frustrated. Staff admitted they had yelled at children after becoming frustrated with them. Staff behavior in this situation is not constructive in nature, age and stage appropriate, or intended to redirect a child to appropriate behavior and resolve conflicts.
