Inspector Notes

An unannounced complaint inspection was conducted on 02/26/2024 from 12:30pm to 3:20pm as the result of a complaint received regarding ratio compliance. Staff were interviewed, documentation was reviewed, and classrooms were observed. Based on a preponderance of evidence gathered during the investigation, the complaint was determined to be valid. There were 2 violations cited as a result of the investigation. Areas of non-compliance are identified in the Violation Notice.

Standard 8VAC20-780-350-B-2
(Repeat Violation) Based on staff interviews, the center did not maintain the required supervision ratio of staff to children whenever children are in care.

Evidence:
1)In the Toddler classroom, Staff stated that during the month of December and the preceding 5 months, they were regularly with up to 15 children where the youngest child present was aged 16 months-24 months with only 2 staff during the hours of 12:00-12:30 and 2:30-3:00 while a 3rd staff member went on a lunch break. This occurred approximately 3-5 days per week.
2)In the Toddler classroom, Staff stated that at approximately 6:30am for 10 minutes on approximately 4-5 days per week, they were with up to 20 children present where the youngest child was aged 16 months-24 months with only 1 staff member.
3)In the Toddler classroom, Staff stated that 1 staff member comes in and out of the classroom for a period of approximately 5 minutes at a time leaving only 2 staff members with up to 15 children ages 16 months-24 months. Staff stated this occurred about a dozen times in the last 2 weeks.
Plan of Correction: Director will review staff schedules to ensure all ratios are covered during naptimes, mornings and at all times. Schedules will be adjusted accordingly to ensure always in compliance.

Based on observation and staff interview, the center did not ensure that one staff member should supervise only one room or area during rest time.
Evidence:
1)In the Pre-K plus classroom (ages 4-5 years), a child exited their classroom to go to the Pre-K 2 classroom 2 doors away to use a restroom. One staff member was supervising both areas- the room with the 5 napping children inside the classroom as well as the hall area with the child who left the classroom to go to another room.
2)In the Preschool 3A classroom (ages 3-4 years) a child exited their classroom to retrieve a backpack in the hallway. One staff member was supervising both areas- the room with the 15 napping children inside the classroom as well as the hall area with the child who left the classroom to go retrieve their backpack.
Plan of Correction: Teachers will call for management when any child needs to use restroom outside of their classroom. Children's items will be moved to inside of classrooms where accessible w/out leaving room.
