The inspection findings have been updated as a result of a second step review completed on 05/06/2024.
The inspection findings have been updated as a result of a first step review completed on 03/28/2024.
The licensing inspector initiated an unannounced inspection on 03/12/2024 and concluded it on 03/13/2024 in response to a complaint received by the department on 03/07/2024 for allegations regarding physical plant and care and protection. Interviews, record reviews and policy reviews were conducted relating to the allegations. The information gathered during the investigation support the allegation, so the complaint is determined to be valid, and violations were documented on the violation notice issued to the facility.

If you?d like to include a plan or correction and date to be corrected for each violation cited, please include that information with the signed and dated copy of the Violation Notice by the deadline. Plans of correction should include steps to correct the noncompliance with the standard and measures to prevent the noncompliance from occurring again.

Standard 8VAC20-780-340-A
Based on interviews and document review, the staff supervising children failed to always ensure their care, protection, and guidance.

Evidence:

On 03/06/2024 Child 1, three years old, was standing on a library ladder, measuring 74 inches and located over a bare floor. The child was attempting to return a toy to a shelf located 78 1/2 inches above the floor. Although a staff person was standing next to him supervising the activity, the child fell to the ground, resulting in a left temporal bone fracture with pneumocephalus and a hematoma behind the child's left ear.
Plan of Correction: We regret this tragic accident occurred. As with any serious injury, our safe keeping team has done a root cause analysis to determine what additional controls, from the hierarchy of controls, can be put in place to prevent this type of injury in the future. We have implemented a "three points of contract" rule for all climbing, consistent with the best safety guidelines and all teachers have been retrained in how to spot climbing children and how to evaluate risk during play.

Based on observation, the center failed to ensure climbing equipment used by preschool children was not more than five feet high when used indoors.

Evidence:

The library ladder in the Literacy Lounge measures 74 inches. Per staff 1 and staff 3 the library ladder is used by children ages three to eight.
Plan of Correction: We are working to bring this ladder into compliance or find an alternative piece of equipment. We believed it was in compliance at the time and appreciate this being brought to our attention so we can bring it into compliance or seek an allowable variance.

Based on observation, the center failed to ensure the climbing portions of indoor climbing equipment 36 inches or more is located over resilient surfacing.

Evidence:

The library ladder in the Literacy Lounge measures 74 inches and is not over resilient surfacing.
Plan of Correction: We are working to bring this ladder into compliance or find an alternative piece of equipment. We believed it was in compliance at the time and appreciate this being brought to our attention so we can bring it into compliance or seek an allowable variance.
