Inspector Notes

An unannounced code compliance inspection was initiated on 1/11/2023 and concluded on 1/11/2023 from 11:00 AM to 11:45 AM. There were 32 children present, ranging in ages from two to five, with 6 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures and medication. A total of three children?s records and four staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Standard 22.1-289.031-A
Based on a review of the parent handbook and interview, the center failed to provide a written disclosure to parents that includes information regarding the fact the center is exempt from licensure, the qualifications of personnel and failed to post the fact that the center is exempt from licensure in a visible location on the premises.

Evidence:

1. The director provided the documentation given to parents. The information did not contain the fact the center is exempt from licensure or the qualifications of the personnel.
2. The director verified the documentation given to parents does not contain information regarding the center's exemption status or the personnel's qualifications.
3. During the tour of the facility a posting of the center's exemption status was not found.
4. The director stated the exemption letter is posted in the director's office which is not in the same building as the preschool classes.
Plan of Correction: The parent handbook will be updated and the addendum will be forwarded to parents. The exemption status will be posted in a visible location.
Standard 22.1-289.031-A-6
Based on a review of the parent handbook and interview, the center failed to provide a written disclosure to parents and guardians of the children in the center and the general public that includes information regarding the physical facilities, enrollment capacity, health requirements of staff and public liability insurance.

Evidence:

1. The information provided to parents was reviewed. The physical facilities, enrollment capacity, health requirements of staff and public liability insurance was not documented in the information provided to parents.
2. The director verified the required information was not provided to parents.
Plan of Correction: The parent handbook will be updated and the addendum will be forwarded to parents.
Standard 8VAC20-770-40-D-2
Based on record review and interview, the center failed to have staff sign a sworn disclosure statement prior to the first day of employment.

Evidence:

1. The record of staff 1, start date 3/10/21, has a sworn statement dated 11/16/22.
2. The director verified the sworn statement dated 11/16/22 is the only sworn statement they have on record.
Plan of Correction: In the future new staff will be required to complete sworn statements upon application.
