Inspector Notes

The inspection findings have been updated as a result of a second step review completed on 10/10/25.

An unannounced inspection was initiated on 6/11/25 with local agencies and completed on 7/15/25 in response to a complaint received by the licensing office on 6/5/25 relating to allegations of forbidden actions and failure to report suspected child abuse. The inspector reviewed staff records on-site and electronically. This inspection included document review, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law, and the violations are documented on the violation notice issued to the program. Though not a part of the original complaint, violations that were not reported were also found and are documented on the violation notice issued to the program.

Standard 63.2-1509-A
As a mandated reporter, an individual in charge of a child day center who receives a
report of suspected abuse or neglect from an employee shall report immediately to the
local department or to the Department's toll-free child abuse and neglect hotline.

On 5/30/25, at approximately 1:40 p.m., a staff member sent pictures of red marks on
Child A?s face to Manager #2, and later informed Manager #2 that they witnessed Staff
#1 cause the red marks on Child A?s face. A second staff member also reported that they
shared their concerns about the incident with Manager #2. Manager #2 failed to report
staff?s concerns as required to the local department.

Standard 8VAC20-780-340-F
Children under 10 years of age always shall be within actual sight and sound supervision of staff.

On 6/4/25 at approximately 5:45pm, Child D, four-years-old, was left alone in the classroom for approximately 1-2 minutes when the rest of the class transitioned with the teacher to another area of the center.

Standard 8VAC20-780-40-E
The licensee is required to ensure that the center?s activities, services, and facilities are maintained in compliance with these standards, the center?s own policies and procedures that are required by these standards, and the terms of the current license issued by the department.

1. On 6/4/25 at approximately 5:45pm, Staff #2 reported that they had become distracted talking to a parent and did not complete their name-to-face accountability procedure during a transition from the classroom to the lobby area. Subsequently, Child D, who was four-years-old, was left alone in the classroom for approximately 1-2 minutes. 2. On 6/3/24 Staff #2 did not complete their name-to-face accountability procedure when transitioning from the playground to the classroom and subsequently left a child alone on the playground for approximately 1 minute before their parent arrived and found them.

Standard 8VAC20-780-400-B
Behavioral guidance is required to be constructive is nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

On 6/2/25, Staff #1 was observed taking Child B, four-years-old, "kicking and screaming, crying, resisting" from the dining room to the adult bathroom outside, off of the playground. Other staff reported hearing the child "screaming and crying" in the bathroom and "a raised adult voice" and the door to the bathroom was locked. Interviews revealed that on multiple occasions, Staff #1 took Child B to both the inside and outside adult bathrooms when the child was having behavioral concerns.

Standard 8VAC20-780-410-1
The following action or threat thereof is forbidden: roughly handling a child.

1. On 5/29/25 in the dining room during afternoon snack, Staff #1 was observed roughly handling Child A, four-years-old. Staff #1 grabbed Child A by the arm in a smacking motion and continued to tightly hold the child?s arm while moving the child to another table. 2. Observed evidence later revealed that during the same time period, Staff #1 also roughly handled Child C, four-years-old, by grabbing the child by the arm, lifting Child C off of their chair, and pulling Child C across the room. 3. On 5/30/25 in the dining room during lunch time, Staff #1 was observed roughly handling Child A, four-years-old. Staff #1 grabbed the front of Child A?s neck then moved their hand up to Child A?s face where they grabbed the child?s face on either side using one hand to force the child to look at them. Red marks were observed on both sides of Child A?s face immediately following the grabbing incident.

Standard 8VAC20-780-80-B-2
The center is required to inform the department?s representative as soon as practicable, but not to exceed two business days, of any injury to a child that occurs while the child is under the supervision of the center and requires outside medical attention.

On February 19, 2025 Child E tripped in the classroom and began complaining that their foot hurt. Staff applied ice but the child continued to complain about their foot hurting. After that day, the child did not return to the center for several days, so staff reached out to the family and learned that the child had broken their foot when they tripped. The child returned to care with a boot on their foot shortly after, but the center did not report the injury to the department.
