On 10/23/2025, the day of the incident, there were no staff present who held a current daily health observation certification.

The center shall ensure that areas and equipment of the center, inside and outside, are maintained in a clean, safe and operable condition.
On the landing at the top of the slide were slats wide enough for a child to fit through. On 10/23/2025, Child #1, (16 months old) fell approximately six feet from the top of the slide to bottom of the playground.The child sustained a skull fracture, concussion, and bruising to the face and body. Staff stated during interviews on 10/30/2025 there was discussion with both the owner and director, with safety issues it presented prior to the incident.

When staff are supervising children, they shall always ensure their care, protection, and guidance.
1. Staff #1 waited approximately 20 minutes after the head injury to call and alert the parent of the incident. Child sustained a skull fracture, concussion, and bruising to the face and body. Child sustained lasting injuries that are requiring continued physical therapy and medical follow up appointments.
2. Emergency responders were not called by the center during the entirety of the incident.
3. Prior to the incident 22 children from 16 months old - school age were allowed to be intermingled on the same playground at the same time.

When children are in ongoing mixed age groups, the staff-to-children ratio and group size applicable to the youngest child in the group shall apply to the entire group.
During interviews on 10/30/2025, staff members confirmed during the incident on 10/23/2025, Staff #2 was left alone on the playground with 22 children of mixed age groups (16months-school age students). Staff #1 and Staff #4 went inside to care for Child #1 leaving Staff #2 alone for an undetermined amount of time.

The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards, and the terms of the current license issued by the department.
The center's emergency medical care protocols state "If an accident or injury is a head injury, life threatening, or one that requires immediate medical attention, the local ambulance service will be called to transport the child to the hospital emergency room. The parents will be notified immediately. The center is required to notify the VA Dept of Education
of the injury immediately upon onset."
1. Emergency responders were not called by any staff members present on 10/23/2025.
2. The parent/guardian was called approximately 20 minutes after the incident occurred.
3. The center did not notify Department of Education about the head injury until after DSS until after VDSS, another state agency, notified the inspector with the report.
