Inspector Notes
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A monitoring inspection was initiated on 2/23/22 and concluded on 2/28/22. The provider was contacted by telephone and a virtual inspection was conducted. There were 8 children present (20 points) with 3 caregivers present. The children were observed in movement and exercise activities, and later breaking up into smaller floor and table top activities. 3 children's records, 3 caregiver's records, attendance and emergency drill records were reviewed.

Violations
2Evidence:
1. Caregiver # 1's record indicated that her first day of employment was 11/28/2021. Caregiver #1's fingerprint based criminal history check was not obtained before the first day of employment.
2. The provider used background check portability instead of the caregiver going to a Field Print site to get fingerprinted. Portability of background checks did not go into effect until 1/1/22.
3. The portability form submitted by the provider was signed and dated 1/31/22.
4. The results of the criminal history check on the background check portability form were obtained on 2/15/22. The fingerprint results were found to be acceptable.
Evidence:
1. Caregiver # 1's record indicates that her first day of employment was 11/28/21.
2. The provider used background check portability instead of submitting the central registry form. Portability of background checks did not go into effect until 1/1/22.
3. The portability form submitted by the provider was signed and dated 1/31/22.
4. The results for the VA central registry search on the background check portability form were dated 2/15/22. The central registry results were found to be acceptable.
