Inspector Notes
An unannounced complaint investigation was conducted jointly with a local agency on May 16, 2023 in response to a complaint received on May 11, 2023 of allegations of care, protection, and guidance. Staff interviews were conducted, physical plant was overserved, and records were reviewed.
The preponderance of evidence does support the allegations and the complaint is deemed valid. Please email me at karen.dickens@doe.virginia.gov with any questions or clarifications.
Violations
4Evidence:
1. According to an incident report dated 05/10/2023, Child #1 was climbing on the raised flower box and fell. Child #1's arms and legs were cleaned off by Staff #1 and checked for broken skin. Staff #1 did not observe any marks or broken skin and Child #1 returned to play.
2. At approximately 2:30pm, Staff #1 stated that she observed a mark on the inner right thigh of Child #1. Staff #1 stated that they assumed that the mark happened at home.
3. At approximately 4:45pm, the parents of Child #1 noticed a large mark on the inner right thigh of Child #1.
4. The wooden flower bed box located on the far left of the playground had splintering and deteriorating wood on two of the outer corners of the flower bed box. The deteriorating wood of the left corner of the box had an exposed metal bolt head that had sharp edges.
Evidence:
1. At approximately 2:30pm, Staff #1 observed a red mark on Child #1's inner thigh. Staff #1 stated that they assumed the mark happened at home and that they did not treat the mark.
2. Staff #1 stated that they did not notify the parents of Child #1 about the observed mark. Staff #1 stated that it is procedure to notify the parents of any marks and bruises observed on children using the Brightwheel app.
3. According to an incident report dated 05/10/2023 at 11:15am, " When [Child #1] was climbing on a raised flower bed [when] she fell. [Staff] cleaned [their] arms and legs. We later found a scratch on [their] inner thigh".
4. Staff #1 stated that they did not associate the mark on the inner right thigh to the fall that happened earlier on the playground.
Evidence:
1. Staff #1(Date of hire-02/28/2022) stated that on May 10, 2023 at approximately 2:30pm, they observed a mark on the inner right thigh of Child #1.
2. Staff #1 stated that it is procedure to notify the parents by the Brightwheel app of any marks or bruises observed on children. Staff #2 stated that it is standard procedure to contact parents about bruises or marks on children.
3. Staff #1 did not notify the parent by the end of the day of any known minor injuries. Staff #1 stated " It is my fault that I did not contact anyone. I assumed it happened at home".
Evidence:
1. According to an incident report dated 05/10/2023, Child #1 sustained a minor injury on the playground.
2. An incident report was written at the end of the day after the parents of Child #1 observed a red mark on the inner right thigh.
3. The incident report did not contain the date and time when parents were notified and any future action to prevent recurrence of the injury.
