Inspector Notes

An unannounced inspection was initiated on August 1, 2024 and completed on August 19, 2024 in response to a complaint received by the licensing office on July 31, 2024 relating to allegations of care and protection and supervision of children. The inspector reviewed 1 child?s record and 6 staff records on-site on August 1, 2024. This inspection included document review, tour of the facility, interviews, and observations.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the deficient practice will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on September 6, 2024. A POC submitted after this date will not appear on the public website.

Based on file review, the center did not obtain the necessary out-of-state background checks for all employees.

Evidence:
The record for Staff #6 (date of hire 6/14/21) was missing an out-of-state child abuse and neglect search.
Plan of Correction: The background checks will be completed today.
Standard 8VAC20-780-270-A
Based on observation, the center did not ensure areas outside were maintained in a safe and operable condition.

Evidence:
A hole approximately 3 inches in diameter was in the turf on the playground across from the office causing a tripping hazard.
Plan of Correction: We will temporarily close the hole with a pool noodle until it can be repaired.
Standard 8VAC20-780-340-A
Based on video review, staff supervising children did not always ensure their care, protection, and guidance.

Evidence:
- Infant #1 (5 months) was non-mobile and unable to roll over. Infant #1 was laid on a plastic tarp on their tummy for approximately 17 minutes between 9:42am and 9:59am. Infant #1 was found limp and unresponsive when staff #4 went to pick them up from their tummy.
-At approximately 9:40am, staff #1, staff #4, staff #5, and staff #6 brought 10 infants, including Infant #1, to the outside playground and laid them on a plastic tarp for water play. Staff #6 left after assisting.
-At 9:42am, Infant #1 was confirmed to be on the plastic tarp on their tummy through a posted photograph.
-From approximately 9:48am to 9:55am, staff #1 began misting the infants with water from the hose.
-At approximately 9:56am, staff #1 and staff #5 began to carry infants inside one-by-one.
-At approximately 9:59am, when staff #4 picked up infant #1 they noticed infant #1 was limp and unresponsive.
-At approximately 10:00am, 911 was called. The police and ambulance arrived on scene at approximately 10:04am.
-Reports taken from medics on scene confirmed there was a small amount of water on the tarp. Statements given to the medics from staff at the school confirmed the infant was found face down in water. Medics reported the child?s clothes were wet and ?while in the medic unit the patient did cough up a small amount of water.?
Plan of Correction: Water play will be redesigned to include water toys and other ways to play with water. Nothing will be used that can accumulate water. Children will always be within arms reach during tummy time and repositioned if not. Children will always be within sight and sound.
Standard 8VAC20-780-360-A
Based on video review and statements, the center did not ensure daily activities for infants were age and stage appropriate.

Evidence:
-From approximately 9:48am to 9:55am, staff #1 began misting 10 infants (including Infant #1), who were laying on a plastic tarp, with water from the hose; causing a small amount of water to form on the plastic tarp.
-Infant #1 (5 months) was non-mobile and unable to roll over. Infant #1 was laid on a plastic tarp on their tummy for approximately 17 minutes between 9:42am and 9:59am. Infant #1 was found face down in water and was limp and unresponsive when staff #4 went to pick them up from their tummy at 9:59am.
Plan of Correction: All staff were re-trained on CPR and First Aid, responding to emergencies, and immediate response. Before re-introducing water play next summer, all infant teachers will be re-trained on new procedures. Playground safety was also reviewed.
