Inspector Notes
Based upon a report from the facility regarding a significant incident, an investigation was begun on 1/18/2023 and concluded on 01/23/2023. The investigation regarding forbidden action included interviews with staff and administration.
Information gathered during the inspection determined a non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the facility.

Based upon interviews, the facility has not ensured that staff do not use forbidden action when disciplining children.
Evidence:
1. Based upon interview with staff 1, staff 3 was sitting on the floor of the classroom with a personal cup beside her. When child 1, eleven months old, reached for the cup, staff 1 said she saw staff 3 swat the child on the hand and heard a "slapping sound".
2. Based upon interview with staff 2, she heard a "sound like a slap" and when she turned to see what had happened, child 1 was looking at her arm.

Plan of Correction: The facility responded with the following:
The school made a report to the VA Department of Education, Office of Child Care Health and Safety. Staff 3 was terminated from employ as consistent with the facility policy by the school administration on the day of the incident.
