Inspector Notes

An unannounced complaint inspection was initiated on 08/21/2023 from 12:45pm to 1:45pm as a result of a complaint received in our office regarding supervision during nap time. There were 6 children present ages 8 months to age 3 years with the Provider and an assistant. All of the children were laying down for nap time at the time of inspection. The program area, attendance, 3 child records, 3 staff records, and documentation were reviewed. The complaint was determined to be invalid, however there were 7 violations cited unrelated to the complaint. The Areas of non-compliance are identified in the Violation Notice.

Please complete the columns for "Plan of Correction" and "Date to be Corrected" for each violation cited on the Violation Notice, and then return a signed and dated copy to the licensing office by 5pm on 9/11/23. Please email me at angela.dudek@doe.virginia.gov with any questions.

Standard 22.1-289.035-B-2
Based on review of 3 Caregiver records, the provider did not obtain documentation of the results of a national fingerprint background check prior to the first day of employment.

Evidence: The record for Caregiver #3 (Date of Hire 8/21/23), did not contain documentation of a fingerprint background check completed prior to the first day of employment.
Plan of Correction: She had it done. I am waiting for the result.
Standard 22.1-289.036-A
(Repeat Violation) Based on review of Provider record, the Provider did not obtain a criminal history background check report every five years from the date of the last check.

Evidence: The record for the Provider did not contain documentation that a criminal history background check report had been completed every five years from the date of the last check. The last criminal check was completed 6/20/18.
Plan of Correction: I have it done and put it in the file.
Standard 8VAC20-770-60-B
Based on review of 3 Caregiver records, the Provider did not obtain documentation of a completed sworn disclosure statement for each caregiver prior to date of hire.

Evidence: The record for Caregiver #3 (date of hire 8/21/23) did not contain documentation of a completed sworn disclosure statement prior to the date of hire.
Plan of Correction: That was her first day and she had it done before closing. It's done and in the file.

Based on review of 3 Caregiver records and interview with the Provider, the Provider did not ensure they maintain a record for each caregiver.

Evidence: There was no file for Caregiver #3 (Date of hire 8/21/23).
Plan of Correction: I hired a new helper and working on her file.
Standard 8VAC20-800-140-B-1
Based on interview and review of Provider record, the Provider did not ensure they had documentation of a current certification in cardiopulmonary resuscitation (CPR) and First aid as appropriate to the age of the children in care, from the American Red Cross, American Heart Association, American Safety and Health Institute, or the National Safety Council, or current CPR certification issued within the past two years by a community college, a hospital, a rescue squad, or a fire department.

Evidence: The Provider does not have documentation of a current certification in CPR or First aid. The certification on file for CPR and first aid expired on 7/31/23.
Plan of Correction: It was scheduled for 9/9/23 and I had it done and it's on file.
Standard 8VAC20-800-50-A
(Repeat Violation) Based on review of the written attendance record and interview with the Provider, the Provider did not ensure they maintained a written record of children in attendance each day.

Evidence:
During the inspection in was determined there were 6 children present, but the written record reflected there were 4 children present.
Plan of Correction: I will make sure to do the attendance on time.
Standard 8VAC20-800-530-F
Based on observation, the provider did not ensure that no soft bedding of any kind should be used under or around infants.

Evidence:
1)Upon arrival to the home, blankets were observed draped over the side of 2 of the infant cribs where infants were resting.
2)A stuffed animal was observed in the crib of one of the infants while they were sleeping in the crib.
Plan of Correction: I will be careful.
