Inspector Notes

This inspection was conducted by licensing staff using an alternate remote protocol, necessary due to a state of emergency health pandemic declared by the Governor of Virginia.

A monitoring inspection was completed on March 23, 2021. The provider was contacted by telephone (video call) to initiate the inspection. There were 26 children present and in the care of four staff members. The inspector was able to view all required documentation. A virtual tour of the children in care was conducted. Three staff records and three children's records were reviewed. Information gathered during the inspection determined non-compliances with applicable standards or law and the violations were documented on the violation notice issued to the facility.

The Licensing Inspector reviewed with the provider COVID-19 Essential Guidance for Child Care programs.

Based on the review of three staff records and discussion with the owner, the National Criminal History Record report and the Search of the Central Registry report were dated more than 90 days prior to the date of employment for one staff member.

Evidence:
1. The record for Staff Member #2 contained a completed National Criminal Background Check through fingerprinting dated 09/28/2020 and a completed Search of the Central Registry dated 10/08/2020. These checks were dated more than 90 days prior to the staff member's first day of employment. The date of employment for Staff Member #2 was 03/10/2021.
2. The owner reported that due to COVID-19 Phase III Guidance which she had received from the Department of Social Services, she understood that she could use background checks that were more than 90 days old at the time of hire.
Plan of Correction: The owner will obtain a new National Criminal History Record report and a new Search of the Central Registry report for Staff Member #2.

Based on the review of three staff records and verification from the owner, the center failed to obtain a National Criminal Background Check through fingerprinting for one staff member prior to the first day of employment.

Evidence:
1. The record for Staff Member #1 contained a completed National Criminal Background Check through fingerprinting dated 02/17/2021. The first date of employment for Staff Member #1 was 02/10/2021 which was prior to receiving the completed background check..
2. The owner confirmed that the background check was not completed before Staff Member #1's date of hire.
Plan of Correction: The owner now understands that the national fingerprint background check must be completed before a staff member can be hired. Moving forward, she will make sure to adhere to this regulation.
