Inspector Notes

This inspection was conducted by licensing staff both on-site and using an alternate remote protocol, including telephone contacts, documents review, interviews and a tour of the program.

A monitoring inspection was initiated on 2/7/22 and concluded on 2/11/22. The center director was contacted by telephone to initiate the inspection and an on-site inspection was conducted on 2/11/22 from 10:50am until 1:30pm. At the time of the on-site inspection, there were 106 children in care with 17 staff. A sample of 5 children's records and 5 staff records were reviewed. Children were observed engaging in learning activities, eating lunch, playing on the playground and resting quietly during nap time. Restroom and handwashing procedures were also observed. First aid and emergency supplies, medication, documentation of emergency practice drills, the emergency preparedness plan and required center postings were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on record review and interview, the center did not ensure that they obtain the results of the fingerprint based background check prior to the first day of employment.

Evidence:
1. Staff 1 has a hire date of 1/25/22. The results of the fingerprint based background check for staff 1 was not received until 1/28/22.
2. The center director confirmed that staff 1 began employment prior to the results of the fingerprint background checks being received.
Plan of Correction: The center responded with the following: Going forward, all fingerprint based background checks will be obtained before new staff begin employment.
Standard 22.1-289.035-B-4
Based on record review and interview, it was determined that the center did not ensure that a copy of the results of a sex offender registry check and a search of the child abuse and neglect registry is obtained from any state in which the individual has resided in the preceding five years.

Evidence:
1. Staff 2 has a hire date of 8/11/21. Staff 2 indicated on her sworn statement or affirmation that she has resided in the state of New York within the past five years. The results of a sex offender registry check and a search of the child abuse and neglect registry were not available for staff 2 from the state of New York.
2. The center director confirmed that all of the required out-of-state background checks were not completed for staff 2.
Plan of Correction: The center responded with the following: The New York sex offender registry check for staff 2 was completed during the inspection. The central registry search request for staff 2 from New York will be completed and mailed. Once received, the results will be forwarded to the licensing insepctor.

Based on record review and interview, the center did not ensure that each staff's record contain all the required information.

Evidence:
1. Staff 3 (date of hire: 12/9/21) is listed as a program leader in her employment file. The record for staff 3 does not contain documentation to demonstrate that the individual possesses the education required by the job position of program leader.
2. The center director confirmed that the record for staff 3 does not contain documentation of education necessary for the qualification of program leader.
Plan of Correction: The center responded with the following: Documentation of staff 3's education will be obtained and placed in her record.
