During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on October 15, 2025 and completed on December 16, 2025 with a local agency in response to a complaint received by the licensing office on October 14, 2025 relating to the allegation of care and supervision. The inspector reviewed 14 child files and 4 caregiver/household member records. This inspection included document and video review, tour of the facility, interviews, and observations.

The preponderance of evidence gathered during the investigation supports the allegation therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on December 22, 2025. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
The provider is required to obtain a completed sworn statement prior to the employee's first day of employment.

The sworn statement for Caregiver 4, was dated two weeks after October 7, 2025.
Plan of Correction: Sworn Statement has been completed and will be completed before any caregiver is authorized to work with children for future references.
Standard 22.1-289.035-B-2
Providers must obtain a completed national criminal background check prior to the employee's first day of employment.

The national criminal background check for Caregiver 4, was dated 8 days after October 7, 2025.
Plan of Correction: National criminal background check has been completed and will be completed before any caregiver is authorized to work with children for future references.

COMPLAINT RELATED
The provider will ensure that during transportation of children that no child is left unattended inside or outside a vehicle.

On October 7, 2025 the parent of Child A found their child left unattended in a motor vehicle parked in the Provider's driveway.
Plan of Correction: Provider has reviewed supervision and transportation policies with caregivers to ensure no child is left unsupervised.

The provider will maintain a record for each caregiver.

On October 7, 2025 Caregiver 4 was left alone to care for and transport children. The Provider did not have a record for Caregiver 4.
Plan of Correction: Record for all caregivers will be maintained before they work with children. Record has been completed.

COMPLAINT RELATED
The provider will ensure that the home's activities, services, and facilities are conducive to the welfare of children in care.

~On October 7, 2025 Caregiver 4 pulled into Provider's driveway and dropped off two children to Caregiver 2. Caregiver 2 took Child B into the home and was unaware that Child A was still in the vehicle. Parent of Child A arrived approximately 10 minutes later to find the child in the vehicle.
Plan of Correction: Caregiver has completed additional training to ensure children's welfare and safety.
Standard 8VAC20-800-560-A
COMPLAINT RELATED
A caregiver will be physically present on site and provide direct care and supervision of each child at all times. This includes awareness of and responsibility for each child in care, including being near enough to intervene if needed.

On October 7, 2025, Caregiver 2 left Child A unattended in a motor vehicle, for approximately 5-10 minutes.
Plan of Correction: Provider has provided additional training to caregivers to ensure they do not leave any child out of site or sound.

The provider must give parents prior notice when a substitute provider will be caring for the children.

The provider had a substitute provider present for approximately 5 hours on October 7, 2025, without notifying parents.
Plan of Correction: Parents will be notified when a substitute is in place.

Before the child's first day of attendance, the provider will obtain the parent's written acknowledgement of the receipt of the information regarding family day home operations and administration.

There was not a signed parent acknowledgement form on file for Child A who had been in care for over 1 month.
Plan of Correction: I will make sure parent signs all signature lines.

The general written permission obtained from parent of each child must include the driver of the vehicle.

Caregiver 4 was not listed as a driver on the permission slip signed by the parents of children who regularly receive transportation to and from school.
Plan of Correction: Permission slip forms have been updated to reflect updated daycare information, and will be updated as needed to reflect any changes.

Special written permission will be obtained from the parent of each child for the provider to take the child on special field trips (those not regularly scheduled). The written special permission will specify destination, duration of trip, and driver, if the child is to be transported.

On October 7, 2025 Caregiver 4 drove Child A and B to another location for approximately 3 hours without prior written permission from the parents.
Plan of Correction: Permission slips will be provided for signature on any irregular planned trips for parents.
