Inspector Notes

An unannounced inspection was initiated on 8/21/25 and completed on 9/30/25 with a local department of social services in response to a complaint received by the licensing office on 8/19/25 relating to allegations of striking a child and not ensuring their care, protection and guidance. The inspector reviewed one child's record and 3 staff records on-site on 8/21/25. This inspection included document review, tour of the facility, interviews and observations.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 10/16/25 A POC submitted after this date will not appear on the public website.

Standard 8VAC20-780-340-A
When staff are supervising children, they shall always ensure their care, protection, and guidance.

On 8/18/25, after child A was hit on the head at approximately 11:15 am with a tablet, no caregiver nor administrator checked on child A for the entire day to see if the child was injured or needed medical attention.
Plan of Correction: All staff were immediately retrained on the following areas The responsibility to check and assess a child immediately after any incident involving potential injury. Proper documentation and reporting procedures for injuries or concerning events. The requirement to notify administration and parents immediately when a child may have been harmed.
Management and staff trained in the importance of active supervision and ensuring every child's safety and wellbeing throughout the day.
Standard 8VAC20-780-340-D
In each grouping of children at least one staff member who meets the qualifications of a program leader or program director shall be regularly present.

On 8/18/25, from 9:30 to approximately 12:30 pm there was no lead qualified staff present in the two year old classroom.
Plan of Correction: The management team will ensure that a qualified staff member is always present in the classroom when this teacher is assigned or needs coverage. The teacher is also in the process of completing Early Childhood Education coursework to meet DOE qualifications.
Standard 8VAC20-780-400-B
Behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

On 8/18/25 staff A declared in the classroom that the children were " expletive, expletive" her off. These statements were made around the two year old children.
Plan of Correction: All staff have been retrained on positive behavior guidance, professionalism, and appropriate language in the classroom.
The management team will continue to monitor classrooms to ensure all interactions are respectful, age appropriate.
Standard 8VAC20-780-410-1
Physical punishment, striking a child, roughly handling or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercise as punishment.

On 8/18/25 staff A engaged in the following forbidden actions:

1. At approximately 11:15 am, staff A hit child A ( 2 years-of-age) on the head with a tablet. The hit made a loud smacking sound and child A rubbed and held the top of their head and moaned after being hit.

2. Between 9:30 am and 11: 15 am staff A kicked child A in the lower leg/foot area and was tapping the child on the back of the head to get the child to move.

3. Between 9:30 am and 11:15 am saff A took child A by the wrist and forcibly sat the child down on the floor.
Plan of Correction: StaffA was immediately terminated upon confirmation of the incident. Their access to the facility and children was revoked the same day.
A follow-up with the child's parent was conducted to ensure ongoing wellbeing and transparency.
All staff completed a mandatory retraining session on:
Positive behavior guidance techniques Prohibited discipline and handling policies Proper reporting procedures for observed or suspected abuse or neglect Strategies for managing challenging behaviors without physical contact
Each staff member reviewed and signed the "No Physical
Punishment and Positive Guidance Policy" to confirm their understanding and commitment to compliance. Classroom observations and unannounced supervisory visits are now being conducted weekly for a 60day period to ensure consistent implementation of positive guidance strategies.
