Inspector Notes

A monitoring inspection was initiated and concluded on 4/19/2022. There were 64 children present, 19 staff supervising. The inspector reviewed compliance in the areas of administration, staff qualifications and training, physical plant, staffing and supervision, programs, special care provisions and emergencies, special services, and backgrounds. A total of 5 child records and 6 staff records were reviewed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Standard 22.1-289.035-B-4
Based on record review, the child day center did not obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years for 3 staff.

Evidence:
1. Staff #4 (date of employment: 11/8/21) resides outside of the state of Virginia. A sex offender registry check and a search of the child abuse and neglect registry for the state of Maryland was not obtained for Staff #4.
2. Staff #5 (date of employment: 8/4/21) resides outside of the state of Virginia. A sex offender registry check and a search of the child abuse and neglect registry for the state of Maryland was not obtained for Staff #5.
3. Staff #6 (date of employment 11/22/21) resides outside of the state of Virginia. The results of a criminal history record information check, sex offender registry check, and a search of the child abuse and neglect registry check for Washington D.C. was not obtained for Staff #6.
Plan of Correction: The sex offender registry checks for Staff #4 and Staff #5 were completed during inspection. The center will provide documentation that all required background checks have been initiated within the next 10 business days.

Based on record review, the child day center did not obtain a sworn statement of affirmation prior to employment for 4 of 6 staff.

Evidence:
1. The sworn statement in the record for Staff #2 (date of employment 3/28/22) was dated 4/5/22.
2. The sworn statement in the record for Staff #3 (date of employment 11/15/21) was dated 11/21/21.
3. The sworn statement in the record for Staff #4 (date of employment 11/8/21) was dated 11/16/21.
4. The sworn statement in the record for Staff #5 (date of employment 8/4/21) was dated 8/11/21.
Plan of Correction: We will ensure background checks are completed prior to date of hire.

Based on record review, the center did not have a central registry finding within 30 days of employment for 1 staff.

Evidence:
1. Staff #5 began employment on 8/4/21.
2. Documentation of central registry results in the record for Staff #5 were dated 10/26/21.
3. Documentation in the record for Staff #5 indicated the central registry check was mailed out on 9/23/21.
Plan of Correction: We will ensure background checks are completed prior to date of hire.

Based on record review, a tuberculosis test was not completed within the last 30 calendar days of the date of employment for 1 of 6 staff.

Evidence:
1. The tuberculosis document in the record for Staff #1 (date of employment 3/21/22) was dated 11/09/2021.
Plan of Correction: We will ensure tuberculosis screenings are completed within 30 days prior to hire.

Based on record review, the center did not maintain a record of the dates of the practice emergency drills for one year.

Evidence:
1. The center was not able to provide documentation of emergency drills practiced prior to January 2022 during inspection.
Plan of Correction: Moving forward, we will keep an ongoing record of drills completed in the building.
