5Standard 8VAC20-780-340-A
The Center is required to ensure the care, protection and guidance of all children in care.
1)On 1/9/26 at 5:55pm, there were 3 staff members and 3 children onsite at the Center. Staff #1 began having behavioral concerns with Child #1 (age 9) that consisted of running around the classroom. Staff #1 asked Child #1 to sit next to them and the Child was placed within 3 feet of Staff #1. Staff #1 did not see Child #1 run out of the Center.
2)Staff #1 became aware that the child ran out of the program, when a parent who was picking up another child, notified staff. By that time the child had already run out of sight into the dark and the staff could not locate the child.
3)When the child left the program, they proceeded to cross different streets 9 times to include crossing a major roadway with a 55 mph speed limit.
4)Child #1 continued up the major roadway along the walking trail where they were approached by 2 motorists on 2 occasions who stopped to inquire about the child?s wellbeing. Child #1 continued away from the Center towards their home.
5)Child #1 was located two miles from the Center, walking in the area of the neighborhood pond.

Plan of Correction: A safety plan has been put in place for Child #1. This plan has been reviewed and signed by all staff. Chimes for doors have been placed on doors we access daily. All staff have been retrained and attended active supervision training.

The Center is required to ensure that children under 10 years of age always be within actual sight and sound supervision of staff.
On 1/9/2026, Staff #1 failed to maintain sight and sound supervision of Child #1 for over an hour after the child ran out of the Center.

Plan of Correction: Additional staff have been placed at the site. Staff #1 has been removed from the site.

The Center is required to ensure that staff do not allow a child to leave the center unsupervised.
On 1/9/2026, Staff #1 failed to supervise the child while being distracted by their cell phone, and the child was then able to leave the program unsupervised.

Plan of Correction: All personal phones are required to be put away. The site phone is accessible at all times.

The Center is required to follow their own policies and procedures regarding procedures for a lost or missing child.
In the Center policies, it states: ?If a student can?t be located, the local police department must be notified immediately.? The Center notified the police 26 minutes after Child #1 went missing instead of notifying them immediately per their policy.

Plan of Correction: Emergency protocol has been reviewed and retrained on by all staff.

The Center is required to ensure they obtain for each child, any chronic physical problems and pertinent developmental information and any special accommodations needed
The Center did not obtain a copy of the Individualized Education Plan (IEP) for a child though they knew a plan existed 5 months ago.
