Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An announced inspection was initiated on December 16 2024 and completed on December 16 2024 in response to a complaint received by the licensing office on December 10 2024 relating to allegations of Supervision, Physical Equipment and Environment, Emergencies, and Care of Children. The inspector reviewed 4 children?s records on-site.

The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law, and the violations are documented on the violation notice issued to the program.

Standard 8VAC20-800-30-E
The provider shall ensure that the home?s activities, services, and facilities are conducive to the welfare of children in care.

On November 27, 2024, Staff #1 fed Child #1 (2-years of age), Child #2 (3-years of age), Child #3 (2-years of age), and Child #4 (2-years of age) chocolate containing tetrahydrocannabinol (THC) and cannabidiol (CBD). Staff #1 reportedly did not read the packaging closely enough to realize that the chocolate bar contained THC and CBD. Each child was fed one 10 gram piece each, and each 10 gram contained 15 mg of THC and 15 mg of CBD. Child #1 and Child #3 required medical treatment as a result of ingesting the poisonous substance.
Plan of Correction: ? I will fully check food labeling before introducing it to the children in my care
? As this was the only product of this type, and was found at the bottom of a storage container over one year after purchase, all products of this nature have been removed from my household.
? No more products of this type will be purchased again
Standard 8VAC20-800-840-A
The provider shall record in the child's record an injury or accident sustained by a child while at the family day home that requires first aid or emergency medical treatment.

Child #1 (2-years of age) and Child #3 (2-years of age) required medical treatment following an incident on November 27, 2024, when the children ingested a poisonous substance while in care. No injury or accident report was created for either child.

The provider shall report to the department within 24 hours the circumstances surrounding a serious injury to a child while under the family day home's supervision.

Child #1 (2-years of age), Child #2 (3-years of age), Child #3 (2-years of age), and Child #4 (2-years of age) ingested a poisonous substance while in care on November 27, 2024, but the provider never reported the serious injuries to the department.

? I would have notified my inspector earlier, but I was also hospitalized from this incident, believing I was having a low blood sugar episode, and was vomiting
? I will never again take the direction of CPS or other agencies when directed to delay reporting to the department

The provider shall complete and submit a written report to the department within five working days of the date of an incident of a serious injury to a child while under the family day home?s supervision.

Child #1 (2-years of age), Child #2 (3-years of age), Child #3 (2-years of age), and Child #4 (2-years of age) ingested a poisonous substance while in care on November 27, 2024, but the provider never submitted a written report of the serious injuries to the department.
