Inspector Notes

An unannounced complaint inspection was conducted on 08/29/2023. There were 60 children, ages 1 month- 4 years old, 14 staff members providing direct care and supervision, and various support staff present during the inspection. The inspector discussed the following with the provider: webinars and model forms. Staff were interviewed and a total of 2 staff records were reviewed. The inspector arrived for the inspection at 9:15 am and departed at 11:00 am.

The information gathered during the complaint inspection did support the complaint and therefore the complaint was determined to be valid. Violations, both related and unrelated to the complaint, were documented on the violation notice issued to the provider.

Standard 8VAC20-780-160-A
Based on record review, the center failed to ensure that each staff member shall submit documentation of a negative tuberculosis screening at the time of employment and prior to coming into contact with children.

Evidence:
1. Staff 1 had a hire date of 07/31/2023. The tuberculosis screening was 08/10/2023. Staff 1 was observed providing care to children.
2. Staff 2 had a hire date of 07/31/2023. The tuberculosis screening was 08/22/2023. Staff 2 was observed providing care to children.
Plan of Correction: Provider will obtain TB prior to hire.
Standard 8VAC20-780-210-A-4
Based on record review, interviews with staff, and observation, the center failed to ensure program leaders meet the program leader qualifications.

Evidence:
Staff 1 was promoted to the role of program leader in the 2-year-old room on 8/10/2023. Staff 3 confirmed staff 1 was the program leader. The record for Staff 1 did not have documentation to show the staff persons, experience or training to meet the requirement of the role of program leader.
Plan of Correction: Provider will ensure program leaders meet qualifications.
Standard 8VAC20-780-240-B
Based on record review and staff interviews, the center failed to ensure that staff shall complete orientation training prior to the staff member working alone with children and no later than seven days of the date of assuming job responsibilities.

Evidence:
1. Staff 1 had a hire date of 7/31/2023. There was no documentation to verify that Staff 1 had completed orientation training in the required timeframe. Staff 3 verified that Staff 1 had not completed orientation. Staff 1 was observed providing care to children.
2. Staff 2 had a hire date of 7/31/2023. There was no documentation to verify that Staff 2 had completed orientation training in the required timeframe. Staff 3 verified that Staff 2 had not completed orientation. Staff 2 was observed providing care to children.
