Inspector Notes

A complaint inspection was conducted on October 30, 2023, in response to a complaint that was received by the department on October 13, 2023, regarding allegations in the care of the children at the center and forbidden action. Provider was interviewed, documentation was reviewed, and observations of provider and children were completed. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. The complaint is determined to be valid for forbidden action. The violation was discussed with the provider at the time of the exit interview.

Based on interview and record review, it was determined that the family day home did not ensure that acts or threats thereof are forbidden of physical punishment including, but not limited to, striking a child.
Evidence:
1. On Friday, October 13, 2023, Staff #1, owner, observed the teacher assistant Staff #2 striking two children with their hands while caring for children at the daycare. Staff #2 ?popped? the children on the leg for discipline and the children began to cry.
2. Staff #1, owner, informed Staff #2 that there is to be no corporal punishment or to ever putting hands on children as discipline. This was agreed to at Staff #2?s date of hire on March 1, 2023.
3. Staff #1 immediately terminated Staff #2 the day of the incident due to using physical punishment on children at the daycare.
Plan of Correction: The provider responded with the following: Staff #1, owner, stated that she has never condoned such behavior of physical punishment. As soon as she observed the physical punishment, she immediately attended to the children and fired Staff #2 on the spot. Staff #1 explained to Staff #2 that at the date of hire, she was aware to never use corporal punishment or put their hands on children for discipline. Staff #1 immediately called the parents of the two children and informed the parents that the staff member was terminated on the spot.
