Inspector Notes

The Licensing Inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 6/30/2023 relating to the provider being over capacity with 11 children in care on 6/29/2023. The provider is licensed to care for 7 children.

An interview was conducted with the caregiver and she admitted she was over capacity on that day. This investigation does support the allegation that the provider was over capacity on June 29, 2023, so the complaint is determined to be valid. See the Violation Notice for findings.

Standard 8VAC20-800-40-A
Based on interview, the provider did not ensure that the total number of children receiving care at any one time does not exceed the maximum licensed capacity of the home.
Evidence:
1. On 6/29/2023, the provider had 11 children in care. The licensed capacity is 7 children in care.
2. The provider stated she had 7 children in care on 6/29/2023 and then 3 additional children were dropped off by their parent(s) for a party around 9:10amand were in her care for approximately 30 minutes. She stated they left at approximately 9:40am. She stated she had a total of 10 children. She had one more additional child arrive at approximately 9:40am giving her a total of 11 children.
Plan of Correction: I will not make the same mistake again.
