The inspection findings have been updated as a result of a review of the ratio violation.

A non-mandated inspection was conducted on August 30, 2023 from 1:55 pm -2:20 pm. in response to a serious injury report on August 16, 2023. The inspector reviewed compliance in the areas of administration, staffing and supervision, programming, and special care and emergencies. A total of one child record and one staff records were reviewed, four interviews were conducted, classroom observation conducted, and review of injury reports and documentation were reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on review of video footage and interview with staff, the licensee did not ensure care, protection and guidance.

Evidence:

The center's video footage in the infant classroom on 08/15/2023, there were four children sitting in bucket seats at the feeding/activity table. Staff #1 pushed the table while children were sitting in the seats and the leg collapsed on the opposite side.

Staff #1 confirmed she was trying to slide the table.

Injury report and staff interview stated Child #1 had a foot fracture.
Plan of Correction: The Director had training with the staff on how to transfer kids when they are in highchairs, carts, etc. in the future. All kids will be taken out before furniture is moved.

Based on staff interview and observation, the center did not maintain required staff to child ratios, 1 staff for every 5 children, as an extension of a temporary staff-to-child ratio variance granted by the Office of Child Care Health and Safety on June 27, 2023.

Evidence: During the inspection conducted on August 30, 2023, in the infant room, Staff #1 was observed alone with 12 children from approximately 1:55pm until 2:20pm. The staff-to-child ratio for children birth to 16 months is 1:4 but the center had an approved variance for 1:5.
