Inspector Notes

A complaint investigation was initiated on November 30, 2023 with another local agency and ended on December 4, 2023 regarding a administration and staffing and supervision. Interviews were conducted, and documentation reviewed. There was preponderance of evidence to support the allegation regarding supervision and administration. The complaint was deemed valid with r Areas of non-compliance are identified in the Violation Notice.

Standard 8VAC20-780-40-E
Based on written documentation, the center failed to follow it's own policy and procedure for behavior guidance.

1. Page 16 of the employee handbook states : " The manager on duty will complete the Plan of Action to Prevent Recurrence of Injury using one of the following choices: * Review classroom safety rules. *Conference with parents about ( For example: appropriate footwear, behavior management plan, etc.) *Design & Implement activities that promote skills. ( For example :gross motor, fine motor, conflict resolution, etc.) NOTE: If one of the above choices does not fit the situation , call your District Director to discuss an appropriate response* The manager and teacher will sign the incident report."
2. Staff #1 did not escalate concerns regarding Child B's ( 1 year 5 months old) behavior to the center director and regional management as needed based on concerns per policy.
3. Staff #1 did not create a written plan in place for Child A's repeat occurrences of scratching other children. The scratching incidents occurred on 9/11/2023, 10/11/2023, 11/21/2023.
4. Staff #1 signed acknowledgement of the Employee Handbook on 6/2022.

Based on interviews and record reviews, parents were not provided at least semiannually in writing information on their child's development, behavior, adjustments and needs.

Evidence: There is no written documentation that the parents of Child A were made aware of behavior concerns or that and a plan put in place that was needed to support child's needs.
