Inspector Notes

A monitoring inspection was initiated on 5/18/2023 and concluded on 6/5/2023. The inspection was in response to a self-reported incident received by the Fairfax Licensing office on 5/18/2023, regarding allegations in the areas of forbidden action and behavior guidance. The investigation was conducted on 5/23/2023, between 9:30 am and 10:30 am, and completed on 6/5/2023. The investigation included interviews with the management team, staff, and witness statements. Based on the preponderance of evidence gathered, violations were cited. For violation details, please refer to the Violation Notice. Standard 8VAC20-780-400-B
Based on staff interviews and witness statements, the center failed to ensure that behavioral guidance was constructive in nature, age, and stage appropriate and intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:

1. On Wednesday, May 17, 2023, at approximately 4:00 pm, it was reported by Staff #2 that Child #1 (2-years-old) was seen kicking a group of wooden blocks in the classroom and running away. Staff #2 and Witness #1 both reported seeing Staff #1 grab Child #1 on the upper arm and pull them away from a table near the classroom door where Child #1 was standing, to sit in a chair at one of the classroom tables. Staff #2 reported hearing Staff #1 say "no" while forcefully pulling Child #1 to their seat.

2. Staff #2 stated that they spoke with Staff #1 after the incident and told them that "it was inappropriate and that they should not put their hands on the children and forcefully pull them." Staff #2 reported that Staff #1 apologized, stating, "I'm sorry, it won't happen again."

Based on staff interviews and witness statements, the center failed to maintain compliance relating to forbidden actions involving physical punishment, striking a child, roughly handling, or shaking a child, restricting movement through binding or tying, forcing a child to assume an uncomfortable position, or exercising as punishment.

Evidence:
