8VAC20-780 Special Care Provisions and Emergencies
Inspector Notes
An unannounced inspection was completed on 04/23/2025 in response to a complaint received by the licensing office on 04/09/2025 relating to allegations related to Programs, Special Care Provisions and Emergencies. The inspector reviewed 1 children?s records and 1 staff recordsThis inspection included: document review, tour of the facility, interviews and observations. The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Standard 8VAC20-780-40-E
The operational responsibilities of the licensee shall include ensuring that the center's activities, services, and facilities are maintained in compliance with these standards, the center's own policies and procedures that are required by these standards.
The center had a sign on the building and a policy in the handbook which states it is a "peanut free" facility. On 04/08/2025 Staff A ate a package of peanut butter crackers and shared it with some of the children. Child #, who has a diagnosed peanut allergy and was given a cracker and developed small welts in her mouth, 911 was called and an Epi Pen was administered to the child.
Plan of Correction: Immediate actions were taken. The child was removed from further food exposure, the Parent contacted, allergy symptoms monitored continuously (5 min increments)and EpiPen was administered. EMS called was and the child transported to emergency car. The center is conducting an Internal review of allergy and emergency medication procedures. All policies are being reviewed.
Standard 8VAC20-780-560-P
A child with a diagnosed food allergy shall not be served any food identified in the written care plan required in 8VAC20-780-60 A 8. Child #1 who has a diagnosed peanut allergy was given a peanut butter cracker by Staff A. As a result, the child developed small welts in the mouth, the center called 911 and administered an Epi-Pen.
