Inspector Notes
This inspection was conducted by licensing staff using an alternate remote protocol, including telephone contacts, documents review, interviews and a virtual tour of the program.
A monitoring inspection was initiated on 03/02/22 and concluded on 03/03/22. The director was contacted by telephone and a virtual inspection was conducted. There were 98 children present with 14 staff supervising. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, programming, medication, special care and emergencies and nutrition. A total of five child records and five staff records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.
Violations
4Evidence: 1) The record for Staff #1, hired on 02/21/22, indicated the staff had resided in another state outside of Virginia within the last five years. The out-of-state sex offender registry check was obtained on 02/24/2022. The record did not contain an out-of-state criminal history record of information check from the state Staff #1 had resided.
2) The record for Staff #3, hired on 11/29/21, indicated the staff had resided in another state outside of Virginia within the last five years. The out-of-state sex offender registry check was obtained on 11/30/21. The out-of-state criminal history record of information check was obtained on 12/06/21. The out-of-state search for founded complaints of child abuse or neglect was requested on 12/01/21, but the results had not been received to date.
3) During interview, a member of management confirmed the required out-of-state background checks for Staff #1 and Staff #3 were not obtained within the required time frames. The out-of-state criminal history record information check and the sex offender registry check are required to be obtained prior to hire. The out-of-state search for founded complaints of child abuse or neglect is required to be requested within the first 30 days of being hired.
Evidence: 1) The central registry finding in the record for Staff #3, hired on 11/29/21, was dated 01/10/22. The record did not contain documentation of any further contact, and the staff was continuously employed.
2) The central registry finding in the record for Staff #4, hired on 11/22/21, was dated 01/03/22. The record did not contain documentation of any further contact, and the staff was continuously employed.
3) During interviews, a member of management confirmed the central registry finding for Staff #3 and Staff #4 were not received within the required time frame.
Evidence: 1) The record for Staff #4, hired on 11/22/21, did not contain documentation that the staff had current certification in CPR and current certification in first aid. The record indicated Staff #4 is a bus driver.
2) During interviews, a member of management reported Staff #4 does not have current certification in CPR or current certification in first aid. Staff #4 is a driver and is the only staff member present with children during transportation.
Evidence: 1) The record for Child #1, enrolled on 02/28/22, did not contain a second emergency contact. 2) During interview, a member of management confirmed the record for Child #1 did not contain a second emergency contact. Each child record should contain the name, address, and phone number of two designated people to call in an emergency if a parent cannot be reached.
