Inspector Notes

An investigation was initiated on 4/28/22 and concluded on 4/29/22 in response to a complaint received by the department regarding allegations in the area of staffing and supervision. An on-site inspection was conducted on 4/28/22 and interviews with staff were conducted. Information gathered during the investigation determined non-compliance with applicable standards or laws. Violations are documented on the violation notice issued to the program and were discussed with the center owner at the conclusion of the investigation.

Based on observation and interview, the center did not ensure that during the stated hours of operation, there shall always be on the premises when one or more children are present one staff member who meets the qualifications of a program leader or program director and an immediately available staff member with direct means for communication between the two of them.

Evidence:
1. On 4/28/22, staff 1 was alone in the center supervising 9 children, ages 3 to 5 years, when inspectors arrived at the building at 10:30am. A tenth child arrived at the center at 10:36am.
a. Staff 1 stated that staff 2 had been present at the center but left at approximately 10:00am due to an emergency.
b. Staff 2 arrived at the center at approximately 11:15am.
2. Staff 1 confirmed that she was alone in the center supervising children with no other staff present on the premises and immediately available for approximately 1 hour and 15 minutes.
Plan of Correction: The center responded with the following: Additional staff have been hired to ensure there is adequate coverage and that the center is in ratio at all times.
