***New Report changing the inspection type from Other to Monitoring***

A non-mandated monitoring inspection was initiated on February 15, 2023 and concluded on March 15, 2023. A self-reported incident was received during a monitoring inspection that took place on February 15, 2023 regarding Board Officer background checks. Interviews/emails were conducted/exchanged on 02/15/2023, 02/28/2023, 03/01/2023, 03/03/2023, & 03/15/2023. Two interviews were conducted.

Information gathered during the inspection determined non-compliance with applicable standards or laws and violations were documented on the violation notice issued to the program.

Standard 22.1-289.036-B-2
Based on interview, the licensee did not ensure to obtain a criminal records check prior to the end of the 30th day of employment/service for new agents/board officers.

Evidence:
1. Staff 1 confirmed that Board Member 1's start date as a board officer was December of 2022.
2. When LI conducted an inspection in February of 2023, Board Member 1 still did not complete a criminal records check (fingerprinting).
3. LI spoke with Board Member 1 and confirmed that the background check (fingerprinting) had not been completed.
Plan of Correction: Board officer stepped down as an officer immediately. Executive Director will make sure that all new board officers will get their background checks within 30 days of being appointed as an officer on the board of directors.

Based on interview, the licensee did not ensure to obtain a copy of the results of a search of the central registry (CPS) or the Sworn Statement by the end of the 30th day of employment/service for new agents/board officers.

Evidence:
1. Staff 1 confirmed Board Member 1 began as a board officer in December of 2022.
2. When LI arrived for inspection in February of 2023, Board Member 1 still had not completed Sworn Statement or Central Registry (CPS) check.
3. LI spoke with Board Member 1 and confirmed that background checks were not completed.
Plan of Correction: Board officer stepped down off the board. Executive Director will inform all new board officers that they need to get all required background checks within 30 days of being appointed to an officer position on the board of directors.
