63.2 Child Abuse and Neglect.

Inspector Notes

A complaint inspection was conducted with an outside agency beginning on January 30, 2024, February 02, 2024, February 06, 2024, February 13, 2024, February 28, 2024 and concluded on March 21, 2024. A complaint was received at the Office of Child Care Health and Safety (Valley) regarding behavioral guidance, physical punishment, and child abuse and neglect. The inspector reviewed compliance in the areas of administration, staff and supervision, programs, and background checks. Eleven interviews were conducted, attendance records, staff schedule and two staff and one child record was reviewed.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Please complete the plan of correction and date to be corrected sections for each violation cited on the violation notice and return it to me within 5 business days from today. Which will be close of business on Friday, April 6, 2024. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s): 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s).

Based on document review and interviews, staff who had reason to suspect that a child is abused or neglected failed to report the matter immediately to the local department of the county or city wherein the child resides or wherein the abuse or neglect is believed to have occurred or to the Department?s toll-free child abuse and neglect hotline.

Evidence:
1. At least four staff members who had knowledge that on 11/06/2023, Staff 1 roughly grabbed Child 1 (age 2 years) by the arm, forcefully moved the child to the other side of the room, and threatened the child failed to report this incident to the local department.
Plan of Correction: Policy and procedures will change after the director of our local DSS will do an in person abuse and neglect training.

Based on document review and interviews, the center failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.

Evidence:
1. On 11/06/2023, in response to Child 1 (age 2 years) biting, kicking, and hitting other children, Staff 1 forcefully lifted Child 1 by the arm, roughly moved the child across the room, and used a raised voice to threaten the child.
