Inspector Notes

A code compliance inspection was initiated on Tuesday, May 2, 2023 and completed on Wednesday, May 3, 2023. On May 2, the inspector was on site from 10:00am to approximately 11:11am. There were 35 children in attendance with six staff directly supervising. During the inspection, the children and staff were observed participating in a variety of activities. Staff were observed having positive interactions with the children. All areas of the facility including classrooms, hallways, the outdoor play area, and bathrooms were inspected. Five children's records and five staff records were reviewed. Additional documentation was submitted electronically on May 3, 2023.

Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on a review of five staff records and interview, the center did not obtain the results of a sex offender registry check and a search of the child abuse and neglect registry or equivalent registry from one state in which one staff member had resided in the preceding five years within the required timeframe.

Evidence: 1) The record of Staff #4, employed on 08/30/21, indicated the staff had resided in anoother state outside of Virginia within the last five years. The record did not contain a sex
offender registry check or a search of the child abuse and neglect registry from the state.

2) During interview, a member of management confirmed the required out-of-state background checks for Staff #4 had not been obtained within the required timeframe.

The out-of-state sex offender registry check is required to be obtained prior to employment and the out-of-state search for founded complaints of child abuse or neglect is required
to be requested within the first 30 days of employment. An out-of-state criminal history record information check was not required because the state participate in the National Fingerprint File (NFF) program through the FBI.
Plan of Correction: The center will request the missing background checks.
