Inspector Notes
A monitoring inspection was initiated on 12/3/21 and concluded on 1/18/22. A self-reported incident was received by the department regarding an allegation in the area of behavior guidance. An on-site inspection was conducted on 12/9/21 and interviews with staff were completed. Documentation and video footage related to the incident was also reviewed. Information gathered during the investigation determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the program.

Based on record review and interview, the center did not ensure that each child shall have a physical examination by or under the direction of a physician before the child's attendance or within one month after attendance.
Evidence:
1. The record for child 1 (date of enrollment: 8/20/21) does not contain documentation of a physical examination.
2. The center director confirmed that that record for child 1 is lacking documentation of a physical examination.

Based on a review of video footage and interviews, it was determined that the center did not ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. The center self-reported that a parent reported they witnessed staff 1 "grab" child 1, age 2, by the arm and "drag" her to her cot on 12/2/21.
2. The parent of child 1 stated she had just dropped the child off at the center and was in her car in the parking lot when she witnessed staff 1 "snatch" child 1 by her arm from a chair and "drag" her across the room to her cot.
3. Video footage provided by the center showed the following incident of inappropriate behavior guidance on the morning of 12/2/21:
a. Child 1 is sitting in a chair by the windows at the front of the classroom with two other children when staff 1 comes over and grabs child 1 by her left shoulder. Staff 1 then lifts child 1 off the floor by her shoulder and takes her to her cot in the back of the classroom.
4. In center documentation, staff 1 admitted that she "grabbed" child 1 because she was not listening when told to get on her cot for nap time.
5. The center director confirmed that staff 1 did not demonstrate age and stage appropriate behavior guidance in the classroom.
