Inspector Notes
An unannounced complaint investigation was initiated on 6/23/22 in response to a complaint received in the licensing office regarding an allegation of a forbidden action-rough handling. Based on a review of documentation and interviews conducted, the allegation was determined to be valid. An additional violation was cited that was not included in the initial allegation. An exit interview was conducted with the Director on 7/20/22. Please complete the "Plan of Correction" and "Date to be Corrected" areas on the Violation Notice for each violation cited and return to me by close of business on 8/10/22. Plans of correction should include steps to correct the noncompliance with the standard, and measures to prevent the noncompliance from occurring again.
Standard 8VAC20-780-400-B
Based on interviews, the center did not ensure that behavioral guidance was constructive in nature and redirected children to appropriate behavior and resolve conflicts. Evidence: Witnesses reported hearing Staff #1 yelling at children to ?Sit down and be quiet!? and ?Stay there!? while roughly grabbing children?s arms and pushing them down into chairs for time-out when the children did not listen to the staff member.
Plan of Correction: The staff member no longer works with our school. New staff members are hired and trainings are being held for them in center.
Standard 8VAC20-780-410-1
Based on interviews, the center did not ensure that a forbidden action- rough handling- did not occur with children. Evidence: Interviews revealed that Staff #1 roughly handled children on several occasions. Witnesses reported observing Staff #1 pulling on multiple children?s arms to get them into a chair for time-out when they did not listen to the staff member. Witnesses reported observing Staff #1 roughing pushing children down into chairs for time-out. Witnesses reported that the children sometimes cried after their arms were pulled or after Staff #1 pushed them down into chairs.
