A complaint investigation was initiated on 3/1/2024 and completed on 4/11/2024 regarding an allegation of failure to report a serious injury, supervision and disrepair of the building and playground.
Inspector Notes
The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing office on 2/15/2024. The facility was toured and records were reviewed. Interviews were conducted with staff relating to the allegation that the center was out of ratio, had physical plant hazards and had not reported a serious injury. The information gathered during the investigation does support the allegation regarding serious injury reporting and physical plant. The complaint is determined to be valid. Violations were documented on the violation notice issued to the program. Violations
3Based on observation and interviews, it was determined that the facility did not ensure all areas and equipment of the center, inside and out, shall be maintained in a safe and operable condition.
Evidence:
1.The wood fence on the playground had boards that were cracked and splintering.
2.On the playground, there was a metal pipe approximately 2 ? inches in diameter protruding approximately 3-4 inches from the ground posing a trip hazard. The pipe had a sharp edge on it.
3.The Director confirmed the fence was cracked and a pipe was sticking up out of the ground.
Evidence:
1. The injury report for child #1 did not contain the time the injury occurred.
2. The Director confirmed the time was not documented.
Evidence:
1.On Friday, January 5th, at approximately 4:40pm, staff contacted child #1?s parent to report a possible injury to the child?s foot or ankle.
2.Child #1 was picked up from the center and taken to the emergency room. The child was treated for a fractured ankle.
3.The parent of child #1 informed the Director over the weekend that the ankle was fractured.
4.The center did not inform the licensing representative of the injury and did not file a serious injury report.
5.The Director confirmed licensing was not informed of the injury.
