Inspector Notes

An unannounced monitoring inspection was conducted on February 21, 2023, in response to a self report made to the Department on January 20, 2023, regarding the care and protection of a child in the center. Staff director was interview, staff and children records were reviewed, training logs were observed, and a tour of the facility was completed. Information gathered during the inspection determined non-compliance with applicable standards or law and a violation was documented on the violation notice issued to the program. The violation was discussed during the exit interview with the center director.

Based on record review and interview, it was determined that the center did not ensure that the following actions of physical punishment or striking a child are forbidden.
Evidence:
1. On January 19, 2023, Staff #2 was in the bathroom assisting Child #1. Child #1 was wiggling and kicking the trash can. When the child was asked to stop, the child did not, and Staff #2 spanked the child on the wrist.
2. Staff #1, the center director, stated that during the internal investigation and interview, Staff #2 admitted to spanking the child on the wrist. Staff #1 terminated Staff #2 the same day of the incident.
Plan of Correction: The plan of correction: Staff #1 terminated Staff #2. Staff #1 will also have all staff members take a refresher training course on appropriate discipline for children in care. Staff has reiterated that there shall never be any type of physical punishment or striking of a child. Staff #1 will have the staff members review the licensing standards regarding forbidden action. Currently there are observers coming into the facility and the center is getting feedback in which they will use constructively and effectively.
