Inspector Notes

An unannounced monitoring inspection was conducted on December 8, 2023. The inspector arrived at 2pm and departed at approximately 3:20pm. There were 12 children present and two staff members. A sample size of nine records were reviewed which included five children?s records and four staff records. The Inspector observed staff and children?s interactions throughout the inspection. Children were observed during group activity, free play, and arts and crafts. The transportation van was observed. Medications were observed. Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented. The violations are listed on the violation notice issued to the center and were reviewed with the site assistant director at the exit interview.

Based on record review and interview, it was determined that the center did not ensure that the criminal history records check is received prior to the first day or employment.
Evidence:
1. Staff #3 (date of hire 10/02/2023) was present at the center and confirmed they started working with children approximately 2 weeks after school started in September. Staff #2 did not have documentation that the criminal checks were completed in their file prior to the date of hire. Staff #2 has a background check for Virginia dated on 10/18/2023, which is after the first day of employment.
2. Staff # confirmed that Staff #3 was a new hire and has been working with children since the second week of school.

Standard 22.1-289.035-B-4
Based on record review and interview, it was determined that the center did not ensure to obtain a copy of the results of a criminal history record information check, a sex offender registry check, and a search of the child abuse and neglect registry or equivalent registry from any state in which the individual has resided in the preceding five years.
Evidence.
1. Staff #4 confirmed on their Sworn Statement (signed on 09/06/2023) that they lived outside of Virginia in the past 5 years and no background checks were completed prior to employment for that state.
2. Staff #1 confirmed that there is no out of state background check completed for Staff #4.
Plan of Correction: The center responded with the following: The center has requested the out of state checks to be completed and will provide the information to the DOE and place results in the staff member?s file. Moving forward, the center will complete all out of state checks prior to hire.
Standard 8VAC20-770-60-C-2
Based on record review and interview, it was determined that the center did not ensure that central registry results by the end of the 30th day of employment was completed.
Evidence:
1. Staff #3 (date of hire 10/02/2023) did not have their results for the Virginia Central registry which is required by the end of the 30th day of employment.
2. Staff #4 (date of hire 09/06/2023) did not have their results for the Virginia Central registry which is required by the end of the 30th day of employment.
3. Staff #2, the assistant director, confirmed that there the Virginia Central Registry results for both Staff #3 and Staff #4 were not in the record. The center did not possess any documentation in the staff records that the registry checks were requested.
