Inspector Notes

An unannounced code compliance inspection was initiated on 09/18/2023 and concluded on 09/18/2023 from 11:00 AM to 2:15 PM. There were 57 children present, ranging in ages from infants to 5, with 12 staff. The inspector reviewed compliance in the areas of administration, physical plant, staffing and supervision, procedures, and medication. A total of five children?s records and five staff?s records were reviewed.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the facility.

Based on a review of the staff handbook and interview, the center failed to implement a procedure to ensure all children in the center are in compliance with immunization provisions of ? 32.1-46.

Evidence:

1. The record for child 2 documented the firs date of attendance as 8/19/22 and the child's birth date as 1/27/22. The documentation of immunizations are dated 3/28/22 and 6/2/22.
2. Staff 6 stated the center does not have updated immunizations for child 2.
Plan of Correction: An updated immunization record will be obtained for child 2. In the future administration will ensure immunizations for children will be kept up to date.

Based on record review and interview, the center failed to request a search of central registry background check within the first 30 days of employment and a criminal history name check prior to the first day of employment for any state in which a staff member resided in the preceding five years.

Evidence:

1. The record for staff 5 documented the employment date as 1/14/22. The sworn statement documents staff 5 lived in Arkansas within five years prior to hire. The record for staff 5 did not contain documentation of a central registry background check or criminal history record being completed in Arkansas.
2. Staff 6 verified out-of-state background checks were not completed for staff 5.
Plan of Correction: From now on if staff have lived outside of VA within five years the background checks will be completed as required.
