During the inspection, the inspector reviewed the areas listed above to include standards found out of compliance during the previous inspection. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated and completed on 6/11/2025 in response to a complaint received by the licensing office on 6/9/2025 relating to allegations of capacity, diapering, and feeding. The inspector reviewed 13 children?s records and 4 staff records on-site. This inspection included document review, tour of the facility, interviews, and observations. The preponderance of evidence gathered during the investigation supports the allegation; therefore, the complaint is determined to be valid. Though not a part of the original complaint, violations that were not reported were found and are documented on the violation notice issued to the program. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 6/25/2025. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
The provider is required to obtain a completed sworn statement prior to the employee's first day of employment.

Staff #3 and Staff #4 who were caring for children at the time of inspection did not have a signed sworn statement or affirmation on file.
Plan of Correction: Signed copies of sworn statements were placed in their files.
Standard 22.1-289.035-B-2
Providers must obtain a completed national criminal background check prior to the employee's first day of employment.

Staff #3 and Staff #4, who were caring for children at the time of inspection, did not have a completed national criminal background check on file.
Plan of Correction: Both of these staffs have CRS records Central Registry of Child Abuse/Neglect on file which were submitted along with the license renewal package.
Standard 8VAC20-800-150-A
The provider shall ensure assistants are at least 16 years of age or older.

Staff #3 was caring for children at the time of inspection and was under 16 years of age.
Plan of Correction: Staff #3 will turn 16 in November 2025, however, they are only assigned to do reporting, and administrative works. Comment complied at the time of inspection.

Repeat Violation

The provider shall obtain from each caregiver at the time of hire documentation of a negative Tuberculosis (TB) test or screening.

Staff #3, who was caring for children at the time of inspection, did not have TB test or screening on file.
Plan of Correction: Acknowledged, TB test is expired for Staff #3, and we applied for them to get new TB document.

Repeat Violation

The provider shall ensure that the total number of children receiving care at any one time does not exceed the maximum licensed capacity of the home.

The provider's licensed capacity is 12 children. On 5/27/2025 the provider was over capacity for approximately 4 and a half hours. On 5/29/2025, the provider was over capacity for approximately five and a half hours. On 5/30/2025, the provider was over capacity for approximately six hours and 50 minutes. On 6/4/2025, the provider was over capacity for six hours and 20 minutes. On 6/5/2025, the provider was over capacity for over five and a half hours. On 6/11/2025, the provider had 13 children present at the time of inspection.
Plan of Correction: As of 6/23/2025, daycare has only 11 kids enrolled as 2 had already left the daycare and had their final notice during the inspection.
Standard 8VAC20-800-430-A
Children under two years of age and children over two years of age who are developmentally ready to climb or descend stairs without supervision shall not have access to stairs.

Staff #2 forgot to close the gate at the bottom of the stairs when going upstairs. Two children under age 2 began to ascend the stairs before the other staff noticed and went to intervene.
Plan of Correction: Acknowledged, all staffs were briefed, and an orientation was given on 6/20/25 about all these violations in order to prevent from happening.
Standard 8VAC20-800-530-A
When being used for sleeping or napping children, cots shall have linens consisting of a top cover and a bottom cover or a one-piece covering that is open on three edges.

Nine children were observed resting on cots and did not have top covers.
Plan of Correction: Acknowledged, and complied.
Standard 8VAC20-800-600-B
Infants and toddlers shall spend no more than 30 minutes of consecutive time during waking hours confined in a crib.

Child #7 (Age 15 months) was awake from nap and standing up hanging over the side of the crib for approximately 45 minutes before the provider removed the child from the crib at the Inspector's request.
Plan of Correction: Acknowledged, won't repeat again.
Standard 8VAC20-800-640-2
The following acts or threats thereof are forbidden: Enclosure in a small, confined space or any space that the child cannot freely exit themself.

Child #6 (Age 2) kept leaving their cot during rest time and Staff #1 placed Child #6 in a crib so they could not freely exit. Staff #1 said Child #6 needed to be confined so they won't scratch other children.
Plan of Correction: Acknowledged, won't repeat again.
Standard 8VAC20-800-640-4
The following acts or threats thereof are forbidden: withholding or forcing of food, water, or rest.

At the time of inspection, Staff #1 stated to a child "If you not sleep, no more snacks" and later stated to another child "If you want snacks then go to sleep."
Plan of Correction: We addressed the concern with the staff member and reinforced that food and rest may not be used as behavior tools.
A refresher training on appropriate communication and behavior guidance has been scheduled for all staff.
