During the inspection, the inspector reviewed the areas listed above. Unless otherwise noted as a violation within this inspection report, the provider was in compliance with the standards reviewed. If there were any serious injuries or fatalities related to a violation, the details will be included in the description of the violation.

Inspector Notes

An unannounced inspection was initiated on September 19, 2024 and completed on October 24, 2024 in response to a complaint received by the licensing office on September 11, 2024 relating to allegations of staffing/supervision and physical plant. The inspector reviewed 5 staff records on-site on September 19, 2024. This inspection included document review, tour of the facility, interviews, measurements.

The preponderance of evidence gathered during the investigation supports the allegation(s); therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.

Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on October 30, 2024. A POC submitted after this date will not appear on the public website.

Standard 22.1-289.035-B-1
The center is required to obtain a completed sworn statement prior to the employee's first day of employment. The sworn statement for Staff #1, who is currently working, did not have a sworn statement completed prior to employment.
Plan of Correction: Teachers/employees will have a packet of things to do before coming in the classroom, each teacher will do a sworn statement after going through the first part of the interview moving on to the second part. So the first paperwork in the file would be the sworn statement.
Standard 22.1-289.035-B-2
Centers must obtain a completed national criminal background check prior to the employee's first day of employment. Staff #1, who was working for two days, did not have a completed national criminal background check.
Plan of Correction: When having anew teacher/employee comes in the center they will get a packet of what to do before the first ay of employment. Things they would need is a fingerprint, background and tb test to come be in the classroom with children.
Standard 22.1-289.035-B-3
The center must request a search of the central registry prior to the employee's first day of employment. Staff #1, who had been working for days, did not have a central registry search requested.

Standard 8VAC20-780-160-A
Documentation of a negative tuberculosis (TB) screening must be submitted at the time of employment, before coming into contact with children, and shall have been completed within the last 30 days of the date of employment. Staff #1 had no documentation and had been employed for two days.
Plan of Correction: Teachers/employees will obtain a TB test before coming to the second part of the interview process. Teachers/employees will have a form/ checklist of what to do for them to be in the classroom for the second part of the interview. They would need to bring in their results of the TB test with them for the second part of the interview.
Standard 8VAC20-780-350-B-3
The required ratio for children 2 year old is one staff per eight children. Staff member acknowledged from September 2, 2024, to September 19, 2024, there was 1 staff member present with 12 children in the classroom for one hour.
Plan of Correction: Twill will come in a little early to accommodate ratios in the classroom. Administration will ask teachers to come in 30mins before their time to make sure ratios are met accordingly, just until new teachers are hire to fill the spots.
Standard 8VAC20-780-440-E
Centers shall ensure cribs are at least 12 inches of space between occupied cribs.
Children were observed sleeping in three cribs There were less than 6 inches of space between the occupied cribs.
Plan of Correction: Teachers will start to have a ruler in the classrooms to make sure that the cribs are 12 in apart. Teachers will move the classrooms around to make sure the cribs are accommodating to the requirement of 12 in apart.
Standard 8VAC20-780-70
Centers must keep a staff record for each staff person. During the inspection, Staff #1 was actively working at the center and providing care for children in 2 year old classroom. Staff #1 did not have record which included the following items:
1. Name, address, verification of age requirement, job title, and date of employment or volunteering; and name, address, and telephone number of a person to be notified in an emergency which shall be kept at the center.
2. Two or more references as to character and reputation as well as competency were checked before employment.
3. Documentation to demonstrate that the individual possesses the education, certification, and experience required by the job position, and orientation and training.

5. Information about any health problems that may interfere with fulfilling the job responsibilities.
Plan of Correction: Teachers/employees that come for the second part of the interview must have the required paperwork to come into the classroom with students. When the first interview is completed, the potential teacher will leave with a packet that will have the required documentation to bring in or have completed for them to be in the classroom with students.
