Based on record reviews, the sworn statement of Staff D was not completed prior to the first day of employment.

Evidence:
Staff D did not have a sworn statement on file. Staff D was hired 01/09/2023.

Based on record review, central registry search results were not complete within 30 days of employment.

Evidence:
1. The central registry search results for Staff A were completed on 12/07/2021. Staff A was hired 05/10/2021.
2. The central registry search results for Staff D were completed on 11/22/2021. Staff D was hired 08/11/2021.

Based on record review, each child did not have a physical examination on file.

Evidence:
Child A (age 2) did not have a physical exam on file.

Based on record review, the documentation of tuberculosis screening was not completed within the last 30 calendar days of the date of employment.

Evidence:
The tuberculosis screening of Staff C was completed 03/26/2021.

Based on interview, staff were not capable of communicating effectively orally.

Evidence:
1. Staff A works with children in the Toddlers 1 class and Staff C works with children in the Toddlers class.
2. Staff A and Staff C were unable to effectively communicate orally as applicable to their job responsibilities.
3. Staff B stated she uses a translator from her other facility to communicate with Staff A and Staff C.
4. A translator was required to interview Staff A and C for this investigation.
5. Staff B confirmed that the children who do not speak Spanish are unable to communicate their wants and needs to Staff A and C.

Based on record review, orientation was not completed prior to working alone with children and within seven days of the first day of employment.

Evidence:
Staff D did not have documentation of orientation on file. Staff D was hired 01/9/2023.

Based on interview, in each grouping of children at least one staff member who meets the qualifications of a program leader was not regularly present.

Evidence:
Staff B stated that from October 2022 until January 2023, a program leader was not regularly present with the Toddlers 1 group (ages 2 and 3 years).

Based on observation, interview and documentation reviewed, the center?s own policies and procedures regarding discipline were not adhered to.

Evidence:
1. The facility?s discipline policy states ?we do not?use any strategy that?forces a child?.
2. On 12/14/2022, in the Toddlers 1 classroom, when Child A (age 2 years) tried to get up to leave circle time, Staff A forced the child back to the circle by grabbing him by the arm and dragging him along the floor.
3. Staff B confirmed the incident occurred and that it resulted in Staff A receiving a written reprimand which stated in part, Staff A ?grabbed a child in the wrong way?.

Based on observation, interview and documentation reviewed, behavioral guidance was not constructive in nature, or age and stage appropriate.

Evidence:
1. A video recorded on 12/14/2022 in the Toddlers 1 classroom showed the following:
a. While the group was sitting in circle time, Child A (age 2 years) tried to get up to leave the area.
b. Staff A pulled the right arm of Child A and dragged him along the floor back to the circle.
2. Staff B confirmed the incident occurred and that it resulted in Staff A receiving a written reprimand.
3. Staff A received a written reprimand for this incident which stated in part, Staff A ?grabbed a child in the wrong way?

Based on record review, a minor injury report was missing required information.

Evidence:
A minor injury report reviewed in the file of Child A was missing the following required information:
1. future action to prevent the injury
2. name child involved in injury
3. treatment of injury
4. parent notification date.

Based on record review, a child?s record was missing required information.

Evidence:
The record of Child A (age 2) was missing the following required information:
1. Father?s residential information
2. Father?s employment information
3. Employer phone number of the mother
4. Start date.

Based on record reviews, staff records were missing required information.

Evidence:
1. The record of Staff A (hired 05/10/2021) and C (hired 08/11/2021) were missing proof of reference checks.
2. The record of Staff D (hired 01/09/2023) was missing the following:
a. An emergency contact
b. Proof of age
c. Proof of reference checks
d. A complete application.
