Inspector Notes
A complaint inspection was initiated on June 27, 2023 in response to a complaint that was received on June 22, 2023 in reference to behavior guidance and physical plant. Documentation was reviewed and interviews were conducted. During the complaint inspection the center self-reported an incident that occurred on June 7th regarding behavior guidance. Follow up interviews were conducted with local agencies on June 29th, July 3rd, and July 5th. The preponderance of evidence gathered during the investigation supports violation of standards regarding the complaint and self-report.
Violations were cited.
Please complete the plan of correction and ?date to be corrected? for each violation cited on the violation notice and return it to me within 5 business days from today, 07/28/2023. Please specify how the deficient practice will be or has been corrected. Your plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again, and 3) person(s) responsible for implementing each step and/or monitoring any preventative measure(s).
Violations
6Evidence: The record for staff #5 (date of employment 3/1/23) had documentation of living outside the state of Virginia within the past 5 years. There was not documentation of a criminal history check, central registry check and sex offender registry search for the state/district listed. Director confirmed the background checks were not completed.
1. The record for staff #2, date of employment 2/7/23, contained documentation of the VDOE training dated 05/16/23.
2. The record for staff #5, date of employment 3/1/23 did not contain documentation of the VDOE training. The Director confirmed that the training had not been completed.
Evidence:
1. Interview with staff #9 revealed that the gates on the playground were not latching properly.
2. Observations confirmed that the gates in between the preschool playground and the toddler playground were not latching properly.
Evidence:
1. Interviews with staff #1, staff #4, staff #5. Staff #6, staff #7, staff #8, staff #9, and staff #10 revealed that staff #3 was witnessed on multiple occasions yelling at the children, making comments such as ?I hate working in this classroom?, and using profanity in front of and directed towards the children.
2. Review of document titled ?Guidance Protection of and Respect for Children OP-300 states that ?employees must adhere to all applicable state and local laws governing child guidance or discipline. Employees are required to use positive guidance techniques and to refrain from any unacceptable measures while caring for children".
Evidence:
1. Interviews with staff #1, staff #4, staff #5. staff #6, staff #7, staff #8, staff #9, and staff #10, revealed that staff #3 was witnessed on multiple occasions yelling at the children, making comments such as ?I hate working in this classroom?, and using profanity in front of and directed towards the children.
2. Written statements and interviews with staff #4, staff #7, and staff #12 revealed that staff #3 was observed on June 7, 2023, using her foot to redirect child #1, age 8 months, to prevent the child from hurting another infant. This caused the 8-month-old child to fall backwards into a boppy pillow.
3. Interview with Director revealed that staff #3 was issued a ?final coaching? on June 7, 2023 for tone of voice and using inappropriate child guidance.
