8VAC20-780 Staffing and Supervision.

Inspector Notes

The licensing inspector conducted an unannounced inspection on 2/2/2023 in response to a self-reported incident that the Department received on 1/4/2022 regarding behavior guidance. The inspector was on site at the center on 2/2/2023 from 10:10 AM until 12:30 PM. Interviews with staff were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the investigation validates the self-reported incident of inappropriate behavior guidance. Violations were cited regarding behavior guidance and center policies.

Based on a review of documentation and interviews, the center did not maintain compliance with their own policies and procedures required by standards.
Evidence:
1. The center's policies and procedures regarding discipline and behavior were not followed on January 2, 2023, when Staff #1 grabbed Child #1 (7 years old) by the upper right arm while the child was running
around in the classroom. Staff #1 continued to tell child #1 to stop running several times before grabbing child #1.
2. The center's discipline and behavior policies state the following: "Sowing Seeds Academy Do Not spank, bite, pinch, pull, slap or otherwise physically punish the children."

Standard 8VAC20-780-400-B
Based on interviews and photographs, the center did not ensure behavioral guidance was constructive in nature, age and stage appropriate, and intended to redirect children to appropriate behavior and resolve conflicts.
Evidence:
1. During interview, it was determined that on January 2, 2023, Staff #1 told Child #1 to stop running several times before grabbing Child #1. Staff #1 grabbed Child #1 (7 years old) by the upper right arm while the child was running around in the classroom.
2. Photos showed Child #1?s right arm was red and bruised in the area where Staff #1 grabbed child #1.
