Inspector Notes
An unannounced inspection was initiated on 5/21/25 and completed on 6/12/25 in response to a complaint received by the licensing office on 5/20/25 relating to allegations of forbidden actions. This inspection included document review, observations and interviews. The preponderance of evidence gathered during the investigation supports the allegations; therefore, the complaint is determined to be valid. Information gathered during the inspection determined non-compliance with applicable standards or law and the violations are documented on the violation notice issued to the program.
Please complete the plan of correction (POC) and date to be corrected sections for each violation cited on the violation notice. Specify how the violation will be or has been corrected. Submit your POC within five (5) business days from today, which will be the close of business on 7/1/25. A POC submitted after this date will not appear on the public website.
Violations
6Center staff, who are mandated reports, that suspects abuse or neglect of a child, shall report the matter immediately to the local department of the county or city wherein the child resides or wherein the abuse or neglect is believed to have occurred or to the Department's toll-free child abuse and neglect hotline.
Between October 2024-May 2025, the staff observing Staff #1 physically punish children did not fulfill their mandated reporter obligations and immediately report these concerns at the time of occurrence.

Two Birds is also mandating that all employees repeat Child Abuse and Neglect Recognition and Reporting / mandated reporter training and is facilitating discussions with staff regarding reportable behavior. On or about 5/14/25, staff observed Staff #1 interact with Child #13 in a demeaning and disrespectful manner, failed to promote the child's well-being including when a decision was made to change the child's clothing in an effort to reduce the demeaning interactions rather than report Staff #1's inappropriate interactions to management.

The following actions or threats thereof are forbidden to include physical punishment, striking, roughly handling, binding or tying a child.
Between October 2024-May 2025, Staff #1 was observed by other staff physically punishing children ages 2-3 years old by physically striking and roughly handling them on a daily and ongoing basis. Children were hit and smacked on their face/head, arms, legs and in the mouth. On or about 11/14/2024, Child #2, was made to hit themself in the face by Staff #1 using the child's hand to hit the child in the face. Children were grabbed, pushed, pulled and yanked by their hands, arms, clothing and hair. During outside walks, the walking rope would often be wrapped tightly multiple times around the children's upper arm if they were not listening and it would be removed before entering the school. Children were picked up by the back of their shirts/collars lifting their feet from the floor. On at least two occasions, Child #1 and Child #4 were lifted by their shirt/collar with their feet as high as Staff #1's waist. In all situations children reacted by crying and screaming.

Between March 2025-May 2025, Staff #1 was observed by other staff lifting Child #4 by their shirt and putting the child in the classroom closet, shutting the closet door and walking away for approximately 1 minute before returning, opening the door and allowing the crying child out. This was also reported by another child in the class to their parent.

Staff #1 was observed by other staff interacting with a 2-year-old child in a manner that was demeaning in an adjacent classroom. On or about 5/14/25, Staff #1 made repeated demeaning and teasing comments throughout the day about Child #13's choice of clothing.

Between October 2024-May 2025, Staff #1 was observed by other staff punishing children for their toileting accidents by smacking them in the head or speaking to them in a stern voice/manner. The following children were punished for toileting accidents: Child #1, #2, #4, #5 and #7.
