Inspector Notes

A complaint inspection was initiated on January 3, 2024 in response to a complaint that was received on December 27, 2023 in reference to behavior guidance and forbidden actions. Documentation was gathered and interviews were conducted. The preponderance of evidence gathered during the investigation supports violation of standards in regard to the complaint.

Violations were cited.

Standard 8VAC20-780-340-A
Based on interviews, the center failed to ensure that when staff are supervising children they shall always ensure their care, protection, and guidance.
Evidence:
Interviews revealed that staff #1 has been observed on multiple occasions yelling at the children and grabbing the children to force them to walk or sit.

Standard 8VAC20-780-400-B
Based on interviews, the center failed to ensure that behavioral guidance shall be constructive in nature, age and stage appropriate, and shall be intended to redirect children to appropriate behavior and resolve conflicts.
Evidence: Interviews revealed that staff #1 was observed yelling at child #1 as she grabbed the child by the wrist and forced the child to sit in time out. Staff #1 was yelling statements such as:
1. What happens when you don't listen?
2. If you don't what's gonna happen?
3. Get your tail up!

Standard 8VAC20-780-410-1
Based on interviews and written statements, the center failed to ensure physical punishment and roughly handling a child are forbidden.
Evidence:
Interviews and written statements revealed that on 12/20/23, staff #1 grabbed child #1 by the wrist, forced the child to stand up, then pulled the child by the wrist, roughly sat the child down, and physically forced the child to stay sitting by holding down the child. Staff #1 was then observed yelling at child #1 to get up to get their diaper changed. When the child did not get up staff #1 walked over to child #1 and yanked the child by the wrist to force the child to stand up. The child then began crying.
