Inspector Notes
An unannounced monitoring inspection was conducted on 03/20/2024 to follow up on previous areas of noncompliance with the terms of the license. The inspection was conducted with two outside agencies. There were 40 children, ages 18 months to 8 years, and 9 staff providing direct care and supervision to children present during the inspection. Children were observed during outdoor time and homework time. Staff were interviewed. Two inspectors arrived for the inspection at approximately 3:30 pm and departed approximately 4:25 pm.
Information gathered during the inspection determined non-compliance with applicable standards or law and violations were documented on the violation notice issued to the provider.
Violations
4Based on observation and interviews with staff, the center failed to ensure that when staff are supervising children, they shall always ensure their care, protection, and guidance.
Evidence:
On 03/20/2024 at approximately 3:30 pm, there were 40 children in care and the licensed capacity for the center is 32. The stipulation shown on the face of the license states no more than 24 children on the outside play area at one time and 36 children, ages 18 months to 8 years, were on the play area. When inspectors arrived, staff could not identify the number of children on the play area or the group they were supervising. There were multiple failed attempts of staff to gain control of the children to count the children. The staff were unable to provide a number of children they were supervising on the playground and the inspectors had to assist with counting children.
Evidence:
On 03/20/2024 at approximately 3:30 pm, there were 36 children observed on the outside play area with 6 staff members. The children were all playing together, and no staff could identify a group of children they were supervising. The youngest child in care was 18 months old. The required ratio for this mixed age group of children was 1 staff to 5 children. Eight staff would be required.
Based on observation the center failed to maintain the operational responsibility of the licensee to ensure that the center?s activities, services, and facilities are maintained in compliance with the center?s own policies and procedures that are required by the standards and the terms of the current license issued by the department.
Evidence:
The terms of current license issued by the department shows a capacity of 32 children. The stipulations shown on the face of the license states the maximum occupancy of the building is 37, including staff and no more than 24 children on the outside play area at one time. On 03/20/2024 at approximately 3:30 pm, there were a total of 40 children, ages 18 months to 8 years, in care and 36 children were on the outside play area. The provider was previously found exceeding licensed capacity on 03/06/2024.
Based on observation and interviews with staff, the center failed to ensure that for each group of children, the center shall maintain a written record of daily attendance that documents the arrival and departure of each child in care as it occurs.
Evidence:
On 03/20/2024 at approximately 3:30 pm, there were 36 children on the outside play area. No children?s attendance was available for review when requested. Children were observed leaving the center with parents and staff were not documenting departures as they occurred.
