Inspector Notes

An unannounced inspection was conducted on 12/07/2023 in response to a complaint received 12/04/2023 regarding center staff using forbidden actions. The inspector was on site from approximately 9:35 a.m. to 1:15 p.m. Interviews were completed, observations were made in the center, and documentation was reviewed. The preponderance of the evidence gathered during the complaint investigation supports the allegation; therefore, the complaint is determined to be valid. Please sign the violation notice and complete the ?plan of correction? and ?date to be corrected? for violation cited on the violation notice and return it to me within 5 business days. The plan of correction should contain: 1) steps to correct the noncompliance with the standard(s), 2) measures to prevent the noncompliance from occurring again; and 3) person(s) responsible for implementing each step and/or monitoring any preventive measure(s). Based on documentation review and interviews review it was determined that staff used the forbidden action of enclosure in a confined space or any space that the child cannot freely exit.
Evidence:
S1 was interviewed by licensing inspector and confirmed the allegation that she uses on the average twice a day the highchair in the classroom to confine C1, age 4, when he was being aggressive to calm down. She reported she removes C1 from the highchair when he is calm.
