8VAC20-780 Staffing and Supervision

Inspector Notes

The licensing inspector conducted an unannounced complaint inspection in response to a complaint that was received by the licensing department regarding allegations related to staffing and supervison. The inspection was initiated on January 24, 2023. During the investigation, interview with staff was completed and observations were made in the center, and documentation was reviewed.

There was a preponderance of the evidence gathered during the investigation support the allegation in staff and supervision; therefore, the program allegation is determined to be valid.

These violations are listed on the violation notice issued to the facility.

Standard 8VAC20-780-350-B-1
Based on record review and staff interview, the licensee did not ensure birth up to 16 months - ratio is 1 staff to 4 children.

Evidence:
The head count sheets maintained by the center for the Infant classroom revealed that the center did not meet the required staff-to-children ratio on the following date:

January 24, 2023, from 8:42am to 9:57am; two staff with 11 children
Plan of Correction: The school was struggling with being able to get staff hired, on boarded, and badged during this time frame. We took action the same week of these violations to close numerous classrooms on various days until we could properly staff and maintain ratios. If ratios cannot be met, management has been directed to close classrooms to prevent further occurences. Management is continuing to hire to ensure that there are back up staff to avoid further issues with this matter.

Based on record review the licensee, did not ensure16 months up to 24 months- ratio 1:5.

Evidence:
The head count sheets maintained by the center for the Two's/Toddlers classroom revealed that the center did not meet the required staff-to-children ratio on the following date:

January 19, 2023, from 10:34am to 11:00am; 1 staff with 11 children
January 20, 2023, from 8:00am to 8:45am; 1 staff with 10 children
January 20, 2023 from 9:30am to11:00am; 2 staff with 12 children
Janaury 20, 2023 from 2:59pm to 4:06; 2 staff with 14 children
Plan of Correction: The school was struggling with being able to get staff hired, on boarded, and badged during this time frame. We took action the same week of these violations to close numerous classrooms on various days until we could properly staff and maintain ratios. If ratios cannot be met, management has been directed to close classrooms to prevent further occurences. Management is continuing to hire to ensure that there are back up staff to avoid further issues with this matter.
